WHEREAS,AT&T Enterprises,LLC maintains a fiber optic line across the Veteran's
Legacy property just south of Eagle Scout Lake,which was installed while the State controlled the
property and will impede development of the Good Life District and expansion of the lake as
planned; and
WHEREAS, it is necessary to move this fiber line to the north side of the property
south of U.S. Highway 281/Airport Road.; and
WHEREAS,AT&T Enterprises,LLC is the only provider authorized to handle this
fiber line and has proposed to move the line at an estimated cost of$433,000.00, which would be
paid by the City in three(3)payments: $192,000.00 upon execution of the agreement, $120,500.00
upon the start of construction and $120,500.00 upon completion; and
WHEREAS,this is an estimate with the actual cost based on the bid received,as well
as unanticipated actual costs once work is underway; and
WHEREAS,all funds will be paid out of Good Life District funds,which have been
collected and budgeted for this project; and
WHEREAS,AT&T Enterprises,LLC will not place the fiber order until such time the
agreement is executed for this project.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the agreement between the City of Grand
Island and AT&T Enterprises, LLC for fiber relocation is hereby approved.
BE IT FURTHER RESOLVED,that the Mayor is hereby authorized and directed to
execute such agreement on behalf of the City of Grand Island and that the City Clerk shall store,
retain,and make available for access all related and herein referenced documents in the same manner
as contracts and agreements are retained.
