An ordinance to amend and retitle Chapter 25 from "Pawnbrokers, Tattooing & Body
Piercing" to "Pawnbrokers, Tattooing, Body Piercing, and Cryptocurrency Machines", to add
Chapter 25,Article III to the Grand Island City Code entitled "Cryptocurrency Machines" and to
create such sections as necessary; to clarify and/or make general corrections to various code
sections, to repeal any ordinance or parts of ordinances in conflict herewith; and to provide for
publication and the effective date of this ordinance.
BE IT ORDAINED BY THE MAYOR AND COUNCILS OF THE CITY OF GRAND
ISLAND,NEBRASK:
SECTION 1. Article III Cryptocurrency Machines, Sections 25-30 thru 25-33 are
hereby added as follows:
CHAPTER 25
PAWNBROKERS,TATTOOING, BODY PIERCING AND CRYPTOCURRENCY
MACHINES
ARTICLE III. CRYPTOCURRENCY MACHINES
25-30 Intent
The intent of this Article is to require any person or business operating or housing a Virtual
Currency Kiosk, Crypto automated teller machine (ATM) or Bitcoin teller machine (BTM), on its
premises to post a written warning providing users with notice of potential fraud risks, to protect
the citizens of Grand Island and to provide criminal punishment for failure to provide such notice.
25-31 Definitions
As used in this Article, the following words or phrases shall have the meanings respectively
ascribed to them:
1. Cryptocurrency:A virtual currency that utilizes cryptography to secure transactions that
are digitally recorded on a cryptographically secured, distributed ledger(blockchain).
2. Crypto ATM or Bitcoin ATM:A stand-alone electronic kiosk that allows users to buy
and sell cryptocurrency in exchange for cash or with a debit card.

3. Virtual Currency Kiosk: A person acting on behalf of, or a mechanical agent of, the
virtual currency kiosk operator to enable the virtual currency kiosk operator to facilitate
the exchange of virtual currency for money, bank credit, or other virtual currency,
including but not limited to by (1) connecting directly to a separate "virtual currency
exchange"that performs the actual virtual currency transmission, or (2) drawing upon
the virtual currency in the possession of the electronic terminal's operator.
4. Blockchain:A decentralized digital ledger that stores information across a network of
computer or nodes in blocks that are verified and validated to ensure legitimate and
accurate transactions.
25-32 Posted Warning Required
Any person or business operating or providing access to a functioning Crypto automated teller
machine (ATM), Bitcoin teller machine (BTM) or Virtual Currency Kiosk on its premises shall
post a written warning in the form of a sign on or adjacent to the Kiosk, Crypto ATM or BTM
providing notice to customers and users of the potential fraud or scam risks associated with
utilizing the Kiosk, Crypto ATM or BTM.
All text must be at least 18 point font and must be conspicuously posted so that it shall be
noticeable, viewable, and readable,to a user of the Kiosk,ATM or BTM while standing in front of
the Kiosk,ATM or BTM.
25-33 Penalties and Confiscation
It shall be unlawful for any person or business operating or providing access to a functional Virtual
Currency Kiosk, Crypto automated teller machine (ATM) or Bitcoin teller machine (BTM) not to
post such a notice and/or to fail to maintain it in conformity with 25-32. All persons with control
over the premises upon which said machine is stored, owners of the machine or premises,
businesses owning the machine or premises, or registered agent of any corporate business
operating,housing,leasing,or otherwise maintaining control over the Kiosk,Crypto ATM or BTM
shall be presumed to be responsible for compliance with this section of code. Anyone cited for
violation of this Article and found guilty thereof shall receive a five-hundred dollar($500.00) fine
for the violation.Each day a Kiosk,Crypto ATM or BTM remains on a premises in non-conformity
with this regulation shall constitute a new violation.

SECTION 2. Any ordinance or parts of ordinances in conflict herewith be, and
hereby are, repealed.
SECTION 3. This ordinance shall be in force and take fifteen days after its passage
and publication, in one issue of the Grand Island Independent as provided by law.
