11/04/2025 Ordinances 10,050 ORDINANCE NO. 10,050 An ordinance to amend Chapter 22 and Chapter 32 of the Grand Island City Code, Sections 22-84, 32-46 and 32-48; to clarify and/or make general corrections to various code sections because a business owner has obtained a class Q liquor license which covers a specific class of vehicle commonly known as a"pedal pub"permits the holder of the license to vend alcohol directly on the pedal pub either while parked or while operational on a City street;to clarify and/or make general corrections to various code sections, to repeal any ordinance or parts of ordinances in conflict herewith; and to provide for publication and the effective date of this ordinance. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NERBASKA: SECTION 1. Sections 22-84, 32-46 and 32-48 of the Grand Island City Code are hereby amended to read as follows: 22-84 Vending Vehicles It shall be unlawful for any person to allow any vehicle used for the purpose of vending merchandise, meats, vegetables, or confectionery, or any other vehicle commonly known as a peddler's car or wagon, to stand on any street longer than ten minutes in any one location. This section shall not apply to holders of liquor licenses which permit vending from a moving vehicle may do so in conformity with their properly granted license. 32-46 Street Vendors; General Rules III A. All street vendors shall make application to the Grand Island Police Department, pay a permit fee and obtain a permit prior to using the streets, alleys, easements or other public property ORDINANCE NO. 10,050 (Cont.) in the City of Grand Island to sell merchandise or commercially prepared, pre-packaged food or drinks. B. The owner of each company making application for a street vendor permit shall show proof of identity with a photo identification card, and shall pay a nonrefundable application fee to the Grand Island Police Department in accordance with the Grand Island Fee Schedule at the time of making such application. C. Processing of such application shall be completed within three working days (Monday- Friday), and shall include a background check of the owner of the company submitting such application. Applicants having a felony conviction will be denied a Street Vendor Permit. D. Street Vendor Permits shall be in effect for 30, 90 or 365 consecutive days from the date of issuance as requested by the vendor and upon payment of the applicable permit fee. E. Street vendors may conduct business only between the hours of 8:00 a.m. and 9:00 p.m. This section shall not apply if the Street vendor holds a validly issued liquor license which permits vending under a Special Party Bus license, Pedal Pub License, or any other validly issued liquor license which permits vending from a vehicle. F. A person shall vend only when the vendor's truck is lawfully parked or stopped. This section shall not apply if the vendor holds a validly issued liquor license which permits vending of alcohol from a moving vehicle. G. A person shall vend only from the side of the vendor's truck away from moving traffic and at the curb or edge of the roadway. ORDINANCE NO. 10,050(Cont.) 32-48 Downtown Business District Streets It shall be unlawful for any person authorized to do business under this Article to conduct such business on any street listed in §13-17 Congested Parking Area of this code. Vendors may do business under this article only if all operations can be contained to a single standard parking spot and they operate for no more than one-hour in the same location. Holders of liquor licenses which permit vending from a moving vehicle may do so in conformity with their properly granted license within the Congested Parking Area from South Front Street to 3rd Street and from Eddy to Sycamore, including connecting streets and alleys. SECTION 2. Any ordinance or parts of ordinances in conflict herewith be, and hereby are, repealed. SECTION 3. This ordinance shall be in force and take effect from and after its passage and publication, within fifteen days in one issue of the Grand Island Independent as provided by law.
