WHEREAS, a public utility easement is required by the City of Grand Island from
Innate Development 2,LLC to survey,construct,inspect,maintain,repair,replace,relocate,extend,
remove, and operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS, a public hearing was held on October 14, 2025, for the purpose of
discussing the proposed acquisition of a utility easement tract through a part of Outlot K,Legacy 34
Fourth Subdivision,Outlot D,Legacy 34 Third Subdivision,Lot Twenty-Four(24),Legacy 34 Sixth
Subdivision, and a part of the West Half of the Southeast Quarter(W1/2, SE1/4), Section Twenty-
Five (25), Township Eleven(11)North, Range Nine (9) West of the 6th PM, in the City of Grand
Island, Hall County, Nebraska; the boundaries of the four (4) utility easements and right-of-way
tracts being more particularly described as follows:
TRACT 1 (EXHIBIT A)
Beginning at the Northeast corner of Outlot K,Legacy 34 Fourth Subdivision,in the
City of Grand Island, Hall County, Nebraska; thence on an assumed bearing of
S00°28'30"E, along the easterly line of said Outlot K, a distance of one hundred
twenty-six and twenty-three hundredths (126.23) feet; thence S11°48'05"W, along
the easterly line of said Outlot K, a distance of forty and ninety-two hundredths
(40.92) feet to a point on the southerly line of said Outlot K; thence S89°22'55"W,
along the southerly line of said Outlot K, a distance of seventeen and seven
hundredths (17.07) feet; thence N11°48'05"E, a distance of forty and fifty-seven
hundredths(40.57)feet;thence N00°39'05"W,a distance of one hundred twenty-two
and seventy-two hundredths (122.72) feet to a point on the northerly line of said
Outlot K; thence N89°31'30"E, a distance of sixteen and fifty hundredths (16.50)
feet to the Point of Beginning.
TRACT 2 (EXHIBIT B)
Beginning at the Southeasterly corner of Outlot D,Legacy Third Subdivision,in the
City of Grand Island, Hall County, Nebraska; thence on an assumed bearing of
N69°49'40"W, a distance of twenty-two and one hundredth (22.01) feet; thence
N44°51'16"E, a distance of forty-nine and sixty-five hundredths (49.65) feet to a
point on the southerly line of an existing fifteen (15) foot wide utility easement;
thence S42°56'08"E, along the southerly line of said existing fifteen(15) foot wide
utility easement,a distance of twenty and one hundredth(20.01)feet to a point on the
southeasterly line of said Outlot D;thence S44°51'16"W,along the southeasterly line
of said Outlot D, a distance of thirty-nine and sixty-nine hundredths (39.69) feet to
the Point of Beginning.
TRACT 3 (EXHIBIT C)
A ten(10.0)foot wide utility easement and right-of-way tract being more particularly
described as follows:
Beginning at the Southeast corner of Lot Twenty-Four (24), Legacy 34 Sixth
Subdivision, in the City of Grand Island, Hall County, Nebraska; thence on an
assumed bearing of S45°34'52"W,along the southerly line of said Lot Twenty-Four
(24), a distance of sixty-six and fifty-eight hundredths (66.58) feet; thence
S80°27'30"W, continuing along the southerly line of said Lot Twenty-Four (24), a
distance of seventeen and forty-nine hundredths(17.49)feet;thence N45°34'52"E,a
distance of eighty and ninety-three hundredths(80.93)feet to a point on the easterly
line of said Lot Twenty-Four (24); thence S44°25'08"E, along the easterly line of
said Lot Twenty-Four (24), a distance of ten (10.0) feet to the Point of Beginning.
TRACT 4 (EXHIBIT D)
A ten(10.0)foot wide utility easement and right-of-way tract being more particularly
described as follows:
Beginning at the North corner of Outlot B, Legacy 34 Second Subdivision, in the
City of Grand Island, Hall County, Nebraska; thence on an assumed bearing of
S45°34'52"W along the northwesterly line of said Outlot B, a distance of three
hundred twenty-one and sixty-five hundredths(321.65)feet to a point on the easterly
line of Lot Twenty-Four(24),Legacy 34 Sixth Subdivision; thence N44°25'08"W,
along the easterly line of said Lot Twenty-Four (24), a distance of ten (10.0) feet;
thence N45°34'56"E, a distance of three hundred twenty-one and sixty-four
hundredths (321.64) feet, thence S44°25'08"E, a distance of ten (10.0) feet to the
Point of Beginning.
The above-described easements and right-of-way tracts containing a combined total of
7,585 square feet or .17 acres, more or less, as shown on the plat dated 8/25/2025,
marked Exhibit "A", Exhibit`B", Exhibit"C", and Exhibit"D" and attached hereto
and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Innate Development 2,LLC on,over and below
the tract of land described herein and as depicted on Exhibit A hereto for one dollar ($1.00) and
mutual benefits received.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
