WHEREAS, a public utility easement is required by the City of Grand Island from
Innate 6,LLC to survey,construct,inspect,maintain,repair,replace,relocate,extend,remove,and
operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS, a public hearing was held on October 14, 2025, for the purpose of
discussing the proposed acquisition of a sixteen and a half(16.5) foot wide utility easement tract
through a part of Outlot J,Legacy 34 Third Subdivision, in the City of Grand Island,Hall County,
Nebraska; the boundary of the utility easement and right-of-way tract being more particularly
described as follows:
Beginning at the Northeast corner of Outlot J, Legacy 34 Third Subdivision, in the
City of Grand Island, Hall County, Nebraska; thence on an assumed bearing of
S00°28'30"E,along the easterly line of said Outlot J,a distance of five hundred and
eighty hundredths (500.80) feet to a point of southerly line of said Outlot J, thence
S89°31'30"W along the southerly line of said Outlot J,a distance of sixteen and fifty
hundredths(16.50)feet;thence N00°28'30"W,a distance of five hundred and eighty-
one hundredths(500.81)feet to a point on the northerly line of said Outlot J;thence
N89°32'23"E,along the northerly line of said Outlot J,a distance of sixteen and fifty
hundredths (16.50) feet to the Point of Beginning.
The above-described easements and right-of-way tracts containing a combined total of
8,263 square feet or .19 acres, more or less, as shown on the plat dated 8/25/2025,
marked Exhibit "A" and attached hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Innate 6, LLC on, over and below the tract of
land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual benefits
received.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
