10/14/2025 Resolutions 2025-353 RESOLUTION 2025-353 WHEREAS, a public utility easement is required by the City of Grand Island from Prairie District Commercial Association,Inc.to survey,construct,inspect,maintain,repair,replace, relocate, extend,remove, and operate thereon, public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on October 14, 2025, for the purpose of discussing the proposed acquisition of a twenty (20.0)foot wide utility easement tract through a part of Outlot M,Legacy 34 Third Subdivision,in the City of Grand Island,Hall County,Nebraska;the boundary of the utility easement and right-of-way tract being more particularly described as follows: Beginning at the northwesterly corner of Outlot M,Legacy 34 Third Subdivision,in the City of Grand Island, Hall County,Nebraska; thence on an assumed bearing of S44°51'16"W, a distance of one hundred forty-six and seventy-one hundredths (146.71) feet to a point on the northeasterly line of an existing utility easement in said Outlot M; thence N28°23'34"W along the northwesterly line of an existing utility easement in said Outlot M, a distance of twenty and eighty-nine hundredths (20.89) feet; thence N44°51'16"E, a distance of one hundred thirty-one and fifty hundredths(131.50)feet to a point on the northeasterly line of said Outlot M;thence S69°49'40"E,along the northwesterly line of said Outlot M,a distance of twenty-two and one hundredth(22.01) feet to the Point of Beginning. The above-described easements and right-of-way tracts containing a combined total of 2,782 square feet or .06 acres, more or less, as shown on the plat dated 8/25/2025, marked Exhibit "A" and attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Prairie District Commercial Association, Inc. on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar ($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
