10/14/2025 Resolutions 2025-352 RESOLUTION 2025-352 WHEREAS, a public utility easement is required by the City of Grand Island from McDonald's USA, LLC to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on October 14, 2025, for the purpose of discussing the proposed acquisition of a twenty(20)foot wide utility easement tract through a part of Lot One (1), Burch Second Subdivision, in the City of Grand Island, Hall County, Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at the Northeast corner of Lot One (1),Burch Second Subdivision, in the City of Grand Island,Hall County,Nebraska;thence westerly along the northerly line of said Lot One(1), on an assumed bearing ofN89°33'33"W, a distance of one hundred fifty-four and thirty-six hundredths (154.36) feet to the ACTUAL Point of Beginning; thence S52°07'03"W, a distance of fifty-seven and seventy-five hundredths(57.75)feet to a point on a northerly line of an existing twenty(20.0)foot wide Utility Easement described in Instrument No. 202504652,recorded in the Hall County,Nebraska Register of Deeds Office;thence N89°33'33"W,along said line,a distance of sixteen and thirteen hundredths (16.13) feet; thence NO°26'27"E, along an easterly line of said existing twenty(20)foot wide Utility Easement,a distance of twelve and seventy-five hundredths(12.75)feet;thence N52°07'03"E,a distance of thirty-seven and nineteen hundredths(37.19) feet to a point on the northerly line of said Lot One (1); thence, thence S89°33'33"E, along the northerly line of said Lot One (1), a distance of thirty-two and twenty-five (32.25) feet to the said Point of Beginning. The above-described easement and right-of-way tract containing a combined total of 1,052.2 square feet or .02 acres, more or less, as shown on the plat dated 9/3/2025, marked Exhibit "A" and attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from McDonald's USA,LLC on,over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
