09/23/2025 Resolutions 2025-333 RESOLUTION 2025-333 WHEREAS, a public utility easement is required by the City of Grand Island from Teta Hospitality, Inc. to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon,public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on September 23, 2025, for the purpose of discussing the proposed acquisition of a utility easement tract through a part of Lot Two(2),Legacy 34 Fourth Subdivision, in the City of Grand Island, Hall County, Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Beginning at a Northeast corner of Lot Two (2), Legacy 34 Fourth Subdivision, in the City of Grand Island, Hall County, Nebraska; thence westerly along a circular curve to the left having a radius of sixty (60.0) feet, a central angle of 037°53'10" and a chord which bears S30°44'15"W, a distance of thirty-eight and ninety-six hundredths (38.96) feet to a point on the northerly line of an existing twenty (20.0) foot wide utility easement; thence S89°22'55"W, along the northerly line of said existing twenty(20.0)foot wide utility easement, a distance of forty-one and forty- three hundredths(41.43)feet;thence N72°38'11"E, a distance of twenty and thirty- one hundredths (20.31) feet to a point of curvature; thence easterly along a circular curve to the right having a radius of forty-three and forty-two hundredths (43.42) feet,a central angle of 050°46'13",and a chord which bears N41°56'58"E,a distance of thirty-seven and twenty-two hundredths(37.22)feet to a point on a northerly line of said Lot Two(2);thence N89°22'55"E,along a northerly line of said Lot Two(2), a distance of seventeen and seven hundredths(17.07)feet to the Point of Beginning. The above-described easement and right-of-way containing a total of 760 square feet or .02 acres, more or less, as shown on the plat dated 8/25/2025, marked Exhibit "A" and attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Teta Hospitality, Inc. on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
