08/19/2025 Resolutions 2025-279 RESOLUTION 2025-279 WHEREAS, a public utility easement is required by the City of Grand Island from KJD, LLC to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on August 19, 2025, for the purpose of discussing the proposed acquisition of a twenty(20)foot wide utility easement tract in Lot One(1), Industrial Foundation Third Subdivision, in the City of Grand Island, Hall County, Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at the Southeast corner of Lot One (1) Industrial Foundation Third Subdivision,in the City of Grand Island,Hall County,Nebraska;thence northerly,along the easterly line of said Lot One (1), a distance of one hundred two (102.0) feet to the ACTUAL Point of Beginning;thence westerly and perpendicular to the easterly line of said Lot One (1), a distance of four hundred thirty-six (346.0) feet to the point of termination. The above-described easement and right-of-way containing a total of 6,920 square feet or .16 acres, more or less as shown on the plat dated 6/30/2025, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from KJD,LLC on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar ($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
