WHEREAS, a public utility easement is required by the City of Grand Island from
Hall County to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and
operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS,a public hearing was held on July 8,2025,for the purpose of discussing
the proposed acquisition of a twenty(20)foot wide electrical easement tract in part of Lot One(1),
Westervelt's Subdivision,in the City of Grand Island,Hall County,Nebraska;the boundary of the
utility easement and right-of-way tract being more particularly described as follows:
Beginning at the Northwest corner of Lot One(1),Westervelt's Subdivision,in the city
of Grand Island,Hall County,Nebraska;thence northeasterly,along a northerly line of
said Lot One (1), on an assumed bearing of N61°28'00"E, a distance of one hundred
fifty-one and eighty-two hundredths (151.82) feet; thence S59°25'18"E, a distance of
one hundred twenty-two and sixty-one hundredths(122.61)feet;thence N00°02'11"W,
a distance of eighty-two and twenty-three hundredths (82.23) feet to a point on a
northerly line of said Lot One (1); thence S89°51'44"E, along a northerly line of said
Lot One(1),a distance of fourteen and seventeen hundredths(14.17)feet to a Northeast
corner of said Lot One(1);thence S28°39'02"E, along an easterly line of said Lot One
(1), a distance of twelve and eighteen hundredths (12.18) feet to a Northeast corner of
said Lot One (1); thence S00°02'11"E, along the easterly line of said Lot One (1), a
distance of one hundred sixteen and twenty-eight hundredths (116.28) feet; thence
S89°57'49"W, a distance of twenty (20.0) feet; thence N19°50'56"W, a distance of
twenty-nine and ten hundredths (29.10) feet; thence N59°25'18"W, a distance of one
hundred eleven and sixty-five hundredths (111.65) feet; thence S61°28'00"W, a
distance of one hundred twenty-eight and fifty-two hundredths (128.52)feet to a point
on the westerly line of said Lot One(1),thence N00°08'16"E,along the westerly line of
said Lot One(1),a distance of thirty-seven and sixty-five hundredths(37.65)feet to the
Northwest corner of said Lot One (1), being the said Point of Beginning.
The above-described easement and right-of-way containing a combined total of.189
acres more or less as shown on the plat dated 5/27/2025,marked Exhibit"A", attached
hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Hall County on,over and below the tract of land
described herein and as depicted on Exhibit A hereto for one dollar ($1.00) and mutual benefits
received.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
