06/10/2025 Resolutions 2025-190 RESOLUTION 2025 -190 WHEREAS, a public utility easement is required by the City of Grand Island from Genuine Diesel,Inc.to survey,construct,inspect,maintain,repair,replace,relocate,extend,remove, and operate thereon,public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on June 10, 2025, for the purpose of discussing the proposed acquisition of a twenty(20)foot wide utility easement tract in a part of Lot Five (5), Westgate Industrial 2" Subdivision, in the City of Grand Island, Hall County,Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: The southerly twenty (20.0) feet of the easterly twenty (20.0) feet of Lot Five (5), Westgate Industrial 2nd Subdivision,in the City of Grand Island,Hall County,Nebraska. The above-described easement and right-of-way containing a total of 400 square feet or .07 acres, more or less as shown on the plat dated 5/2/2025, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Genuine Diesel, Inc. on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
