06/10/2025 Resolutions 2025-189 RESOLUTION 2025 -189 WHEREAS, a public utility easement is required by the City of Grand Island from Hornady Family Limited Partnership to survey,construct,inspect,maintain,repair,replace,relocate, extend,remove,and operate thereon,public utilities and appurtenances,including power lines;and WHEREAS, a public hearing was held on June 10, 2025, for the purpose of discussing the proposed acquisition of a twenty(20)foot wide utility easement tract in a part of the North Half of the Northeast Quarter(N1/2,NE1/4)of Section Twenty-Four(24),Township Eleven (11)North,Range Ten(10)West of the 6TH PM,in the City of Grand Island,Hall County,Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at the Southwest corner of Lot One (1), Anderson Third Subdivision in the City of Grand Island, Hall County,Nebraska; thence northerly, along the westerly line of said Lot One (1), a distance of three hundred one (301.0) feet to the ACTUAL Point of Beginning; thence westerly and perpendicular to the westerly line of said Lot One (1), a distance of fifty-two (52.0) feet to a point of termination being on the westerly property line of tract of land described in Instrument#201008762, recorded in the Hall County,Nebraska Register of Deeds Office. The above-described easement and right-of-way containing a total of.023 acres,more or less as shown on the plat dated 5/6/2025, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Hornady Family Limited Partnership on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar ($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
