04/22/2025 Resolutions 2025-142 RESOLUTION 2025-142 WHEREAS, a public utility easement is required by the City of Grand Island from CHI Nebraska to survey,construct,inspect,maintain,repair,replace,relocate,extend,remove,and operate thereon, public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on April 22, 2025, for the purpose of discussing the proposed acquisition of a twenty(20.0)foot wide utility easement tract through apart of Lot Three (3), Veterans Legacy South Subdivision, in the city of Grand Island, Hall County, Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at the Southwest corner of Lot Three (3), Veterans Legacy South Subdivision,in the City of Grand Island,Hall County,Nebraska;thence S89°44'53"E, and running along the southerly line of said Lot Three (3), a distance of three hundred six and thirty-three hundredths(306.33)feet to the ACTUAL Point of Beginning;thence N00°15'07"E, a distance of four hundred thirty-eight and forty-nine hundredths (438.49) feet; thence S89°44'53"E, a distance of eighty-eight (88.0) feet; thence S00°15'07"W, a distance of twenty (20.0) feet; thence N89°44'53"W, a distance of sixty-eight(68.0) feet; thence S00°15'07"W, a distance of four hundred eighteen and forty-nine hundredths(418.49)feet to a point on the southerly line of said Lot Three(3); thence N89°44'53"W and running along the southerly line of said Lot Three (3), a distance of twenty (20.0) feet to the said Point of Beginning. The above-described easement and right-of-way containing a total of.23 acres,more or less as shown on the plat dated 3/4/2025, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from CHI Nebraska on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
