04/22/2025 Resolutions 2025-141 RESOLUTION 2025-141 WHEREAS, a public utility easement is required by the City of Grand Island from Store Capital Acquisitions, LLC to survey, construct, inspect, maintain, repair, replace, relocate, extend,remove, and operate thereon,public utilities and appurtenances,including power lines;and WHEREAS, a public hearing was held on April 22, 2025, for the purpose of discussing the proposed acquisition of a thirty(30.0)foot wide utility easement tract in a part of Lot One(1),Platte Valley Industrial Park Fourth Subdivision,in the City of Grand Island,Hall County, Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at the northeast corner of Lot One (1) Platte Valley Industrial Park Fourth Subdivision; thence southerly along the easterly line of said Lot One (1) Platte Valley Industrial Park Fourth Subdivision,a distance of three hundred sixteen and sixty five hundredths (316.65) feet to the ACTUAL point of beginning; thence deflecting right 88°58'13" and running westerly, a distance of two hundred twenty two(222.0)feet. The side lines of the easement tract shall be prolonged or shortened as required to terminate on the boundary of Grantor's property. The above-described easement and right-of-way containing 0.153 acres,more or less, as shown on the plat dated 2/7/2025, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Store Capital Acquisitions, LLC on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
