01/28/2025 Resolutions 2025-35 RESOLUTION 2025-35 WHEREAS, a public utility easement is required by the City of Grand Island from Innate 8,LLC to survey,construct,inspect,maintain,repair,replace,relocate,extend,remove,and operate thereon,public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on January 28, 2025, for the purpose of discussing the proposed acquisition of an easement tract in part of Outlot A, Legacy 34 Fifth Subdivision, in the City of Grand Island, Hall County, Nebraska; the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at the East corner of Lot Two (2),Legacy 34 Fifth Subdivision,in the City of Grand Island, Hall County, Nebraska; thence on an assumed bearing of S45°34'52"W, a distance of four and eighty-five hundredths (4.85) feet; thence S00°37'30"E,a distance of ninety-five and sixty-five hundredths(95.65)feet to the ACTUAL Point of Beginning; thence S24°42'17"W, a distance of one hundred thirty-three and eighteen hundredths(133.18)feet;thence N57°28'03"W,a distance of ten and ten hundredths (10.10) feet; thence N24°42'34"E, a distance of one hundred seven and fifty-seven hundredths (107.57) feet; thence N47°07'28"E, a distance of twenty-six and twenty-two hundredths (26.22) feet to the said Point of Beginning. The above-described easements and right-of-way containing a total of.028 acres,more or less, as shown on the plat dated 10/11/2024, marked Exhibit "A" and attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Innate 8, LLC on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
