01/14/2025 Resolutions 2025-16 RESOLUTION 2025-16 WHEREAS,a public utility easement is required by the City of Grand Island from Michael and Lauren Schumacher to survey, construct, inspect, maintain, repair, replace, relocate, extend,remove, and operatethereon,public utilities and appurtenances,including power lines; and WHEREAS, a public hearing was held on January 14, 2025, for the purpose of discussing the proposed acquisition of an easement tract in part of the North Half of the Southwest Quarter(N1/2, SW1/4)of Section One(1),Township Eleven(11)North,Range Nine(9)West of the 6th PM, Hall County,Nebraska, the centerline of the twenty(20.0) foot wide utility easement and right-of-way tract being more particularly described as follows: Commencing at the Southwest corner of the North Half of the Southwest Quarter (N1/2,SW1/4) of Section One(1), Township Eleven(11)North, Range Nine(9) West of the 6th PM, Hall County, Nebraska; thence northerly along the West line of the said North Half of the Southwest Quarter(N 1/2,SW 1/4), a distance of three hundred seven and ninety-four hundredths (307.94) feet; thence easterly and parallel with the South line of Lot One (1), Audrey Subdivision, a distance of thirty-three (33.0) feet to a point on the East right-of-way line of Shady Bend Road, said point being the ACTUAL Point of Beginning; thence continuing easterly and parallel with the South line of said Lot One(1), Audrey Subdivision, a distance of four hundred thirteen and fourteen hundredths (413.14) feet; thence deflecting left 90°00'00" and running northerly, a distance of forty-one(41.0) feet to the point of termination. The above-described easement and right-of-way containing a total of.20 acres,more or less as shown on the plat dated 11/15/2024, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Michael and Lauren Schumacher on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
