WHEREAS, a public utility easement is required by the City of Grand Island from
Starostka Group Unlimited, Inc. to survey, construct, inspect, maintain, repair, replace, relocate,
extend,remove, and operate thereon,public utilities and appurtenances,including power lines; and
WHEREAS, a public hearing was held on January 14, 2025, for the purpose of
discussing the proposed acquisition of an easement tract in part of the North Half of the Northwest
Quarter(N1/2,NW1/4)of Section Twelve(12),Township Eleven(11)North,Range Ten(10)West
of the 6th PM, in the City of Grand Island, Hall County, Nebraska, the boundary of the utility
easement and right-of-way tract being more particularly described as follows:
Beginning at the Northwest corner of Lot One (1), Sterling Estates Ninth
Subdivision, in the City of Grand Island, Hall County,Nebraska; thence southerly
along the westerly line of said Lot One(1), a distance of ten (10.0) feet; thence
westerly and parallel with the southerly right-of-way line of Capital Avenue, a
distance to three hundred seventy-seven and fifty-six hundredths (377.56) feet;
thence southwesterly and parallel with the southeasterly line of an existing Drainage
Easement described in Instrument No. 202200419 recorded in the Hall County,
Nebraska Register of Deeds Office, a distance of twenty-three and eighty-five
hundredths (23.85) feet; thence southerly and parallel with the easterly right-of-way
line of Grove Avenue, a distance of two hundred five and fifty-nine hundredths
(205.59) feet to a point on the extension of the southerly line of Northwest
Subdivision; thence westerly along the extension of the southerly line of said
Northwest Subdivision, a distance of ten(10.0) feet to a point on the easterly right-
of-way line of said Grove Avenue; thence northerly along the easterly line of said
Grove Avenue, a distance of two hundred nine and one hundredth(209.01) feet to a
point on the southeasterly line of said existing Drainage Easement; thence
northeasterly, along the southeasterly line of said existing Drainage Easement, a
distance of thirty-one and eighty-four hundredths (31.84) feet to a point on the
southerly right-of-way line of said Capital Avenue; thence easterly along the
southerly line of said Capital Avenue, a distance of three hundred eighty-two and
sixty-five hundredths feet to the Northwest corner of said Lot One(1), being the said
Point of Beginning.
The above-described easement and right-of-way containing a total of.14 acres,more or
less as shown on the plat dated 9/10/2024, marked Exhibit "A", attached hereto and
incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Starostka Group Unlimited, Inc., on, over and
below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)
and mutual benefits received.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
