12/03/2024 Resolutions 2024-317 RESOLUTION 2024-317 WHEREAS, the City's current coal transportation contract with the Union Pacific Railroad Company expires on December 31, 2024; and WHEREAS, Utilities Department staff has solicited proposals from Union Pacific Railroad to continue coal transportation to Platte Generating Station; and WHERAS,Union Pacific Railroad has offered a contract for coal transportation to Platte Generating Station for the term January 1, 2025 through December 31, 2027; and WHEREAS, Union Pacific Railroad provided the only responsive bid; and WHEREAS, Grand Island City Code section 27-12 permits a contract be awarded without competition when after advertising for bids the City Council determines that there is only one source for the required supply or service,authorizes the negotiation with the provider which has been conducted, and authorizes a direct negotiation process be used for up to ten years before requiring additional public solicitation; NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA,that the negotiated contract for coal transportation with the Union Pacific Railroad is hereby approved and a sole source procurement process is authorized for a period not to exceed ten years. BE IT FURTHER RESOLVED,that the Mayor is hereby authorized and directed to execute the contract for coal transportation with the Union Pacific Railroad Company on behalf of the City of Grand Island and any other necessary documents or negotiated contracts through December 3, 2034.
