11/05/2024 Resolutions 2024-295 RESOLUTION 2024-295 WHEREAS, The Grand Island Public Library currently uses Midwest Tape's hoopla Digital Media Platform("hoopla,"the"Platform,"or the "hoopla Platform")which allows participating libraries to provide their users with access to digital media content using smart phones,tablets, computers, streaming devices, and web browsers; and, WHEREAS, the Platform is designed to be accessible 24/7 and offers various licenses to media content in multiple formats, including, without limitation, movies, television programs, music, audiobooks, eBooks, and comics, subject to circulation limits (if any) and other settings established by the user's library system; and, WHEREAS, the Library wishes to continue to make hoopla available to its authorized users ("Patrons"); and, WHEREAS, the Platform charges the Library for each individual item accessed by a Patron which has resulted in highly variable invoices and has resulted in the cost of providing Hoopla exceeding $30,000 per year; and, WHEREAS, the State of New York has procured services from Midwest Tape by and through its contract No. PC9938 and made contract award 23260 which was procured in a manner consistent with the requirements of the City of Grand Island; and, WHEREAS, Midwest Tape has agreed to allow the City of Grand Island to purchase hoopla by and through this New York State contract and to assist the Library in implementing a budgetary cap on hoopla services; and, WHEREAS, to control expenses, and to ensure as many Patrons have access to hoopla as possible each month, the Library intends to implement certain limitations on the use of hoopla including check-out limits and monthly spending limits; NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the Mayor is hereby authorized to execute such documents as may be necessary on behalf of the City of Grand Island to purchase up to $80,000 per year in hoopla services through Midwest Tape by and through the New York State Contract and that this authorization shall be good for three years, through the end of fiscal year 2027 resulting in a total contract price not to exceed $240,000 through FY27. BE IT FURTHER RESOLVED, that the Library Director is authorized to implement any restrictions on hoopla use as may be deemed necessary to ensure hoopla services are available to patrons within the limits of available funds.
