10/08/2024 Resolutions 2024-255 RESOLUTION 2024-255 WHEREAS, a public utility easement is required by the City of Grand Island from 3MJR, LLC to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon,public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on October 8, 2024, for the purpose of discussing the proposed acquisition of an easement tract in part of Lot One(1),Two(2),Three(3), Four (4), Thirteen (13), Fourteen (14), Fifteen (15), and Sixteen (16), all in Jaxson Second Subdivision, in the City of Grand Island, Hall County, Nebraska, the boundary of the utility easement and right-of-way tract being more particularly described as follows: The westerly two (2.0) feet of the easterly seven (7.0) feet of Lot One (1), Jaxson Second Subdivision, in the City of Grand Island, Hall County,Nebraska. The westerly two (2.0) feet of the easterly seven(7.0)feet, except the southerly eleven (11.0)feet of Lot Two(2),Jaxson Second Subdivision,in the City of Grand Island,Hall County,Nebraska. The westerly four (4.0) feet of the easterly nine (9.0) feet of Lot Three (3), Jaxson Second Subdivision, in the City of Grand Island, Hall County,Nebraska. The westerly four(4.0) feet of the easterly nine (9.0) feet, except the southerly eleven (11.0)feet of Lot Four(4),Jaxson Second Subdivision,in the City of Grand Island,Hall County,Nebraska. The easterly seven (7.0) feet of the westerly twelve (12.0) feet, except the southerly eleven(11.0)feet of Lot Thirteen(13),Jaxson Second Subdivision,in the City of Grand Island, Hall County,Nebraska. The easterly seven (7.0) feet of the westerly twelve (12.0) feet of Lot Fourteen (14), Jaxson Second Subdivision, in the City of Grand Island, Hall County,Nebraska. The easterly two (2.0)feet of the westerly seven(7.0)feet, except the southerly eleven (11.0)feet of Lot Fifteen(15),Jaxson Second Subdivision,in the City of Grand Island, Hall County,Nebraska. The easterly two (2.0) feet of the westerly seven(7.0) feet of Lot Sixteen(16),Jaxson Second Subdivision, in the City of Grand Island, Hall County,Nebraska. The above-described easement and right-of-way containing a combined total of .06 acres, more or less as shown on the plat dated 9/5/2024, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from 3MJR,LLC,on,over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar ($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
