WHEREAS, a public utility easement is required by the City of Grand Island from
Chief Industries,Inc to survey,construct,inspect,maintain,repair,replace,relocate,extend,remove,
and operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS, a public hearing was held on September 10, 2024, for the purpose of
discussing the proposed acquisition of two(2)utility easement tracts in part of Lot Two(2),Prairie
Commons Fourth Subdivision,in the City of Grand Island,Hall County,Nebraska,the boundary of
the utility easement and right-of-way tract being more particularly described as follows:
TRACT 1 (Exhibit A)
Commencing at a Northeast corner of Lot Two (2), Prairie Commons Fourth
Subdivision,in the City of Grand Island,Hall County,Nebraska;thence on an assumed
bearing of S20°34'06"E, on the East line of said Lot Two (2), said point also being the
West right-of-way line of Prairieview Street,a distance of one hundred ninety-eight and
forty-six hundredths(198.46)feet;thence S69°26'33"W,a distance of seven and eleven
hundredths (7.11) feet to a point on a West line of a seven (7.0) foot wide utility
easement and also being the ACTUAL Point of Beginning;thence S20°33'14"E on said
West existing easement line, a distance of twenty (20.0) feet; thence S69°26'33"W, a
distance of two hundred thirteen and seventy-six hundredths(213.76)feet to a point on
the northerly line of an existing eighty (80.0) foot wide trail, utility, and drainage
easement and also being on a point of curvature; thence around a curve in a counter
clockwise direction, on said northerly easement line and having a delta angle of
10°52'22",having a radius of one hundred twenty five(125.0)feet,and a chord bearing
N52°56'58"W,a chord distance of twenty-three and sixty-nine hundredths(23.69)feet;
thence N69°26'33"E, a distance of seventy-four and seventy-nine hundredths (74.79)
feet; thence N20°33'27"W, a distance of twenty-eight and thirteen hundredths (28.13)
feet; thence N69°26'33"E, a distance of twenty (20.0) feet; thence S20°33'27"E, a
distance of twenty-eight and thirteen hundredths (28.13) feet; thence N69°26'33"E, a
distance of one hundred thirty-one and sixty-six hundredths (131.66) feet to the said
Point of Beginning.
TRACT 2 (Exhibit B)
Commencing at the Southwest corner of Lot Two (2), Prairie Commons Fourth
Subdivision,in the City of Grand Island,Hall County,Nebraska;thence on an assumed
bearing of N01°39'23"W, along the West line of said Lot Two (2), a distance of eighty
(80.0) feet to the intersection of the North line of an existing eighty (80.0) foot trail,
utility, and drainage easement and the South line of an existing twenty (20.0) foot
utility-drainage easement; thence N88°13'S1"E, on said North and South easement
lines, a distance of ten(10.0)feet to the point of intersection of said North line of said
eighty (80) foot trail, utility, and drainage easement and the East line of said twenty
(20.0) foot utility-drainage easement, said point also being the ACTUAL Point of
Beginning;thence N01°39'23"W,on said East line of twenty(20.0)foot utility-drainage
easement,a distance of two hundred forty-seven and twenty-eight hundredths(247.28)
feet to a point on the South line of an existing seven (7.0) foot utility easement, said
point also being a point of curvature; thence around a curve in a counter clockwise
direction on said South easement line having a delta angel of 08°27'23",having a radius
of one hundred two (102.0)feet, a chord bearing S87°25'41"E and a chord distance of
fifteen and four hundredths(15.04)feet;thence N88°20'37"E, on said South line of an
existing utility easement, a distance of one and fifty hundredths (1.50) feet; thence
S43°20'37"W, a distance of nine and nineteen hundredths (9.19) feet; thence
S01°39'23"E,a distance of two hundred thirty-nine and sixty-five hundredths(239.65)
feet to a point on the said North line of an existing eighty (80.0) foot trail, utility, and
drainage easement;thence S 8 8°13'51"W,on the said North line,a distance often(10.0)
feet to the said Point of Beginning.
The above-described easement and right-of-way containing a combined total of .17
acres, more or less as shown on the plats dated 8/6/2024, marked Exhibit "A" and
Exhibit"B" attached hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Chief Industries, Inc, on, over and below the
tract of land described herein and as depicted on Exhibit A and Exhibit B hereto for one dollar
($1.00) and mutual benefits received.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
