09/10/2024 Resolutions 2024-212 RESOLUTION 2024 - 212 WHEREAS, a public utility easement is required by the City of Grand Island from Precision AG Industries, LLC to survey, construct, inspect, maintain, repair, replace, relocate, extend,remove, and operate thereon,public utilities and appurtenances,including power lines;and WHEREAS, a public hearing was held on September 10, 2024, for the purpose of discussing the proposed acquisition of a twenty (20) foot wide utility easement tract in part of the Northwest Quarter of the Northwest Quarter (NW1/4,NW1/4) of Section Five (5), Township Ten (10)North,Range Nine(9)West of the 6th PM in the City of Grand Island,Hall County,Nebraska, the boundary of the utility easement and right-of-way tract being more particularly described as follows: Commencing at a point on the Northwest corner of Section Five (5), Township Ten (10)North, Range Nine (9) West of the 6th PM, in the City of Grand Island, Hall County,Nebraska; thence on an assumed bearing of S88°17'43"E, along the said North line of the Northwest Quarter (NW1/4), a distance of one thousand three hundred three and eighty-nine hundredths (1,303.89) feet; thence S00°38'06"W, a distance of thirty-three (33.0) feet to a point on the southerly right-of-way line of Schimmer Drive, said point also being the ACTUAL Point of beginning; thence continuing S00°38'06"W, a distance of six and eighty-seven hundredths (6.87) feet to the Northwest corner of Lot Twenty (20), Platte Valley Industrial Park Third Subdivision; thence S00°36'39"W, along the West line of said Lot Twenty (20), a distance of eighty and ninety-nine hundredths (80.99) feet; thence N88°17'43"W, a distance of twenty (20.0) feet; thence N00°36'39"E, a distance of eighty-eight(88.0) feet to a point on the southerly right-of-way line of said Schimmer Drive; thence S88°17'43"E, along the southerly line of said Schimmer Drive, a distance of twenty and one hundredths (20.01) feet to the said Point of Beginning. The above-described easement and right-of-way containing a total of.04 acres,more or less as shown on the plat dated 8/6/2024, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Precision AG Industries, LLC, on, over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
