WHEREAS, a public utility easement is required by the City of Grand Island from
Prairie Commons Hospitality,LLC to survey,construct,inspect,maintain,repair,replace,relocate,
extend,remove,and operate thereon,public utilities and appurtenances,including power lines;and
WHEREAS, a public hearing was held on August 13, 2024, for the purpose of
discussing the proposed acquisition of a twenty(20)foot wide utility easement in part Lot Four(4),
Prairie Commons Sixth Subdivision, in the City of Grand Island, Hall County, Nebraska, the
boundary of the utility easement and right-of-way tract being more particularly described as follows:
Commencing at the Northeast corner of Lot Four (4), Prairie Commons Sixth
Subdivision in the City of Grand Island,Hall County,Nebraska;thence westerly,along
the northerly line of said Lot Four (4), a distance two hundred fourteen and six tenths
(214.6)feet to the ACTUAL Point of Beginning;thence southerly and perpendicular to
the northerly line of said Lot Four(4), a distance of ninety-four(94.0) feet to the point
of termination.
The above-described easement and right-of-way containing a combined total of.043
acres, more or less as shown on the plat dated 3/5/2024, marked Exhibit "A" attached
hereto and incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND,NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Prairie Commons Hospitality,LLC,on,over and
below the tract of land described herein and as depicted on Exhibit A hereto for one dollar($1.00)
and mutual benefits received.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
