ORDINANCE NO. 9979 An ordinance rezoning certain tracts of land within the zoning jurisdiction of the City of Grand Island; changing the land use classification of a tract of land comprising part of the East 1/2 of the Southwest Quarter (E1/2 of the SW1/4) of Section Twelve (12), Township Eleven (11) North, Range Ten (10) West of the 6th P.M., in Hall County, Nebraska. Located north of 13th Street and west of Claude Road in Grand Island, Nebraska from R2 Low Density Residential Zone to R4 High Density Residential Zone in Grand Island, Hall County, Nebraska as more particularly described below, and directing that such zoning change and classification be shown on the Official Zoning Map of the City of Grand Island; amending the provisions of Section 36- 44; and providing for publication and an effective date of this ordinance. WHEREAS, the Regional Planning Commission on June 5, 2024, held a public hearing and made a recommendation on the proposed zoning of such area; and WHEREAS, notice as required by Section 19-923, R.R.S. 1943, has been given to the Board of Education of School District No. 2 in Hall County,Nebraska; and WHEREAS, after public hearing on June 25, 2024, the City Council found and determined the change in zoning be approved and made. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. The following tracts of land is hereby rezoned and reclassified and changed from R2 Low Density Residential Zone to R4 High Density Residential Zone: R4 HIGH DENSITY RESIDENTIAL ZONE A TRACT OF LAND LOCATED IN PART OF THE EAST HALF OF THE SOUTHWEST QUARTER (E1/2, SW1/4) OF SECTION TWELVE (12), TOWNSHIP ELEVEN (11) NORTH, RANGE TEN (10) WEST OF THE 6TH P.M., IN THE CITY OF GRAND ISLAND, HALL COUNTY,NEBRASKA, DESCRIBED AS FOLLOWS: ORDINANCE NO. 9979 (Cont.) COMMENCING AT THE NORTHEAST CORNER OF LOT 21, MILLENNIAL ESTATES SECOND SUBDIVISION AND ALSO BEING A POINT ON THE SOUTH LINE OF LOT 2, STARLITE SUBDIVISION, SAID POINT BEING THE POINT OF BEGINNING; THENCE S89°59'18"E, ALONG SAID SOUTH LINE OF LOT 2, STARLITE SUBDIVISION, A DISTANCE OF 453.57 FEET TO THE NORTHWEST CORNER OF A TRACT AS DESCRIBED IN WARRANTY DEED, INST. NO. 202302305, FILED 05/11/2023 AT THE HALL COUNTY REGISTER OF DEEDS; THENCE S00°35'44"E, ALONG THE WEST LINE OF SAID TRACT, A DISTANCE OF 1542.55 FEET TO A POINT BEING THE SOUTHWEST CORNER OF SAID TRACT AND A POINT ON THE NORTH LINE OF AN UNPLATTED TRACT AS RECORDED IN INST. NO. 201602896, FILED ON 05/10/2016 AT THE HALL COUNTY REGISTER OF DEEDS; THENCE N89°49'27"W, ALONG SAID NORTH LINE OF AN UNPLATTED TRACT, A DISTANCE OF 136.68 FEET TO THE NORTHWEST CORNER OF SAID UNPLATTED TRACT; THENCE N66°54'09"W A DISTANCE OF 32.91 FEET; THENCE N00°41'12"W A DISTANCE OF 135.01 FEET TO A POINT OF CURVATURE; THENCE AROUND A CURVE IN A CLOCKWISE DIRECTION HAVING AN ANGLE OF 23° 05' 50", HAVING A RADIUS OF 127.00 FEET, AND A CHORD BEARING S77°46'38"W A CHORD DISTANCE OF 50.85 FEET; THENCE S89°19'33"W A DISTANCE OF 317.15 FEET TO THE NORTHEAST CORNER OF LOT 39 AND ALSO BEING THE SOUTHEAST CORNER OF MEADOW ROAD RIGHT-OF-WAY AS PLATTED IN MILLENNIAL ESTATES SECOND SUBDIVISION; THENCE N00°40'27"W, ALONG SAID MEADOW ROAD RIGHT-OF-WAY, A DISTANCE OF 60.00 FEET TO THE NORTHEAST CORNER OF SAID MEADOW ROAD RIGHT-OF-WAY; THENCE N89°19'33"E A DISTANCE OF 307.06 FEET; THENCE N00°35'44"W A DISTANCE OF 1161.67 FEET; THENCE S89°19'31"W A DISTANCE OF 226.57 FEET TO THE SOUTHEAST CORNER OF LILAC LANE RIGHT-OF-WAY AS PLATTED IN SAID MILLENNIAL ESTATES SECOND SUBDIVISION; THENCE N00°35'44"W, ALONG AN EAST LINE OF SAID MILLENNIAL ESTATES SECOND SUBDIVISION, A DISTANCE OF 186.19 FEET TO THE POINT OF BEGINNING. SAID TRACT CONTAINS A CALCULATED AREA OF 401776.84 SQUARE FEET OR 9.224 ACRES MORE OR LESS OF WHICH 2.778 ACRES ARE NEW DEDICATED ROAD RIGHT-OF-WAY ALONG WITH THE ADJACENT RIGHT OF WAY FOR CLAUDE ROAD AND THE MOORE'S CREEK DRAINWAY. SECTION 2. That the proposed development plan for the above described real estate, as shown on the plan submitted with the rezoning request is approved finding that such approval conform to the Grand Island Comprehensive Plan and that such development will enhance the City and provide for the health, safety and welfare of the citizens of Grand Island by providing additional housing opportunities. - 2 - ORDINANCE NO. 9979 (Cont.) SECTION 3. That the Official Zoning Map of the City of Grand Island, Nebraska, as established by Section 36-44 of the Grand Island City Code be, and the same is, hereby ordered to be changed, amended, and completed in accordance with this ordinance and that the approved development plan be kept in the records of the Hall County Regional Planning Department. SECTION 4. That this ordinance shall be in force and take effect from and after its passage and publication, within fifteen days in one issue of the Grand Island Independent as provided by law.
