06/11/2024 Resolutions 2024-140 RESOLUTION 2024 -140 WHEREAS, a public utility easement is required by the City of Grand Island from Timothy and Heidi Hiebner to survey,construct,inspect,maintain,repair,replace,relocate,extend, remove, and operate thereon,public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on June 11, 2024, for the purpose of discussing the proposed acquisition of two (2)ten(10) foot wide utility easement tracts in part Lot One (1), Fawnacres Second Subdivision, Hall County, Nebraska, the boundary of the utility easement and right-of-way tract being more particularly described as follows: TRACT 1 The Northerly line of the ten(10.0)foot wide tract being more particularly described as follows: Commencing at the Northeast corner of Section Twenty Seven(27), Township Eleven (11) North, Range Ten (10) West of the 6TH PM, Hall County, Nebraska; thence southerly, along the easterly line of said Section Twenty Seven(27), a distance of one thousand two hundred twenty and sixty hundredths (1,220.60) feet; thence deflecting right 89°47'18"and running in a westerly direction,a distance of fifty-two and forty-two hundredths (52.42) feet to a point of intersection of the westerly right-of-way line of Engleman Road, as described in Instrument#202204279 recorded in the Hall County, Nebraska Register of Deeds Office, and the northerly line of Lot One (1), Fawnacres Second Subdivision,said point also being the ACTUAL Point of Beginning of Tract 1; thence continuing westerly, along the northerly line of said Lot One (1), a distance of one hundred twenty (120.0) feet to the point of termination. TRACT 2 The centerline of the ten (10.0) foot wide tract being more particularly described as follows: Commencing at the Northeast corner of Section Twenty Seven(27), Township Eleven (11) North, Range Ten (10) West of the 6TH PM, Hall County, Nebraska; thence southerly, along the easterly line of said Section Twenty Seven(27), a distance of one thousand two hundred twenty and sixty hundredths (1,220.60) feet; thence deflecting right 89°47'18"and running in a westerly direction,a distance of fifty-two and forty-two hundredths (52.42) feet to a point of intersection of the westerly right-of-way line of Engleman Road, as described in Instrument#202204279 recorded in the Hall County, Nebraska Register of Deeds Office and the northerly line of Lot One (1), Fawnacres Second Subdivision; thence southerly, along the westerly right-of-way line of said Engleman Road,a distance of one hundred two and fifty-six hundredths(102.56)feet to the ACTUAL Point of Beginning of Tract 2; thence westerly and perpendicular to the westerly right-of-way line of said Engleman Road, a distance of eighty-five (85.0)feet to the point of termination. The above-described easement and right-of-way containing a combined total of.047 acres, more or less as shown on the plat dated 4/1/2024, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Timothy and Heidi Hiebner,on,over and below the tract of land described herein and as depicted on Exhibit A hereto for one dollar ($1.00) and mutual benefits received. BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to execute all documents necessary to effect the purpose of this Resolution.
