Notice appeared in the Grand Island Independent on September 9, 2016; and was posted on September 8, 2016. A quorum present, President Alan Lepler called the meeting to order at 5:30 p.m. The following members were present: Alan Lepler, Rob Czaplewski, Kelli Arens, Becky Rosenlund, Sapna Purawat, and Ed Meedel. Steve Fosselman, Library Director and City Council Member Julie Hehnke were also present. Open Meetings Law Notice: Provided by President Alan Lepler. The Board Development committee will also be meeting on by-laws and board operations policies. Approval of Agreement in Principal with Hall County for Issuance of Household Cards to Hall County Nonresidents: A review of the two year contract was presented. Motion by Ed Meedel, seconded by Rob Czaplewski carried unanimously to approve an Agreement in Principal with Hall County for Issuance of Household Cards to Hall County Nonresidents Approval of Agreement in Principal with Grand Island Community Foundation to Accept Donation of Sculpture: As part of Grow Grand Island’s goal to develop long-range corridor improvement plans and signature gateway beautification projects, several works by renowned artist Jun Kaneko are being considered for the sculpture in the Rain Garden. The Grand Island Community Foundation would be the lead fiscal agent in securing donations for this purpose and is anticipating an application for support from Principal (Principal Financial Group Foundation). Motion by Ed Meedel, seconded by Kelli Arens carried unanimously to approve an Agreement in Principal with Grand Island Regular Meeting - 10/17/2016 Page 5 / 34 2 Grand Island community Foundation to Accept Donation of Sculpture. Approval of Designation of $5,000 in Library Trust Funds for Purchase of Nonfiction Books in FY 2016-17: A Library Trust Fund exists within the City of Grand Island to be used for the purchase of nonfiction books. This fund has accumulated without use and due to a reduction in our FY 2016-17 book budget these funds can be designated if needed for book purchases. Motion by Rob Czaplewski, seconded by Becky Rosenlund carried unanimously to approve a Designation of $5,000 in Library Trust Funds for Purchase of Nonfiction Books in FY 2016-17. After months of committee work and analysis, on October 17 the Library Board will be considering approval of an agreement between the city, library and county “for the purpose of granting library use and privileges and for providing library cards to Hall County residents living outside the city limits of Grand Island”. If approved, the agreement will go to the County Board and City Council for approval. In the spirit of cooperation and in anticipation of a successful contract, we have been issuing free household cards since October 1. So far, so good! We are looking forward to making this new contract work for all Hall County residents. Many of you will remember the free card service and bookmobile under our old contract. While we will no longer have a bookmobile traveling through the county, the value of a free library card is immense! Many thanks to Alan Lepler and Rob Czaplewski on the Library Board committee, Jane Richardson, Gary Quandt and Pam Lancaster on the County Board committee, the Library Board and County Board for already approving this contract in principal, and to County Attorney Jack Zitterkopf and City Attorney Jerry Janulewicz for their expertise in crafting the agreement. Our facility has a lot of flexibility, and if you’ve been around long enough you’ve seen us on the move several times. We started doing our latest move in August. Please take a look at the recent changes to both the adult/teen and children’s areas. The adult fiction and nonfiction stacks were moved around to allow for future growth in teen services including a possible makerspace (3-D printer and other high-tech creative tools). The more pronounced separation between adult fiction and nonfiction has allowed us to increase the size of the paperback section. Study tables were rearranged and will be retrofitted for power as a convenience to those with laptops using our wifi. The children’s section audiovisual shelving and teen/reference shelving were switched out to make the children’s shelving lower. The easy reader books have been incorporated into the Discovery Center as we start to enhance this area in order to encourage greater use of these materials by pre-schoolers and early elementary students. We are adding casters to the yellow picture book bins and will be moving those around as well to incorporate them more into the Discovery Center. And soon we will be adding some more seating for parents as they playfully learn with their children. Such moves and GILIBRARY 2020 are solid and well-thought-out guides to move library services into the future along with our fantastic community. Our Library Board will soon be reviewing concepts that will turn into a renovation project funded by a donation from the Myrtle Grimminger estate (more details soon). We are also looking at grant funding for several of our GILIBRARY 2020 initiatives and of course, we cooperate closely with Grow Grand Island as our library helps build a strong community 12 ways! Upcoming Retirement of Librarians Gerianne Pickering and Kathleen Nonneman Kathleen will be retiring in the first part of December and Gerianne at the end of December. Combined, we are losing over 40 years of experience. I am working with City Administrator Marlan Ferguson to ensure continuity of services with a plan that follows the personnel goals you have approved to bring our Library Assistant II level up to 4 FTE and to bring back an assistant director-level Librarian. I will have more details to share at our meeting. 2. FY 2016-17 Budget Approved by City Council The City Council approved the budget at its Tuesday, September 13 meeting. If the budget book has been finalized by our meeting I will make a presentation on its library-related sections. 3. Nebraska Library Association Annual Conference This meeting will be held in Omaha October 20 and 21. I will be attending both days, and Alan Lepler will attend on Thursday with staff members Celine Swan and Becky Otte. 4. Staff Contact: Grand Island Regular Meeting - 10/17/2016 Page 29 / 34 Library Board Monday, October 17, 2016 Regular Meeting Item F1 Approval of Interlocal Cooperative Agreement for the purpose of granting library use and privileges and for providing library cards to Hall County residents living outside the city limits of Grand Island Staff Contact: Steve Fosselman Grand Island Regular Meeting - 10/17/2016 Page 30 / 34 1 INTERLOCAL COOPERATIVE AGREEMENT FOR THE GRANTING OF GRAND ISLAND PUBLIC LIBRARY USE AND PRIVILEGES TO HALL COUNTY RESIDENTS LIVING OUTSIDE OF THE CITY LIMITS OF GRAND ISLAND BY AND AMONG THE COUNTY OF HALL, NEBRASKA, THE CITY OF GRAND ISLAND, NEBRASKA, AND THE GRAND ISLAND PUBLIC LIBRARY BOARD THIS AGREEMENT is made and entered into by and among the County of Hall, Nebraska, a body politic and corporate and a political subdivision of the State of Nebraska, hereinafter referred to as the “County,” the City of Grand Island, Nebraska, a body politic and corporate and a political subdivision of the State of Nebraska, hereinafter referred to as the “City,” and the Grand Island Public Library Board, hereinafter referred to as “Library”, WITNESSETH: WHEREAS, the Interlocal Cooperation Act, NEB.REV.STAT. §13-801 et seq., provides that units of local government of the State of Nebraska and Nebraska state agencies may enter into agreement for the joint and cooperative exercise of powers, privileges or authority capable of being exercised by either agency; and WHEREAS, the Interlocal Cooperation Act further provides that any one or more public agencies may contract with any one or more public agencies to perform any governmental service, activity or other undertaking which each public agency entering into the contract is authorized by law to perform; and WHEREAS, County and Library wish to enter into this interlocal agreement for the purpose of granting library use and privileges and for providing library cards to Hall County residents living outside the city limits of Grand Island, and WHEREAS, Nebraska Revised Statute Sec. 51-208 authorizes the library board of any public city library to contract with the county board in which the library is located to furnish the use and privileges of its library to the inhabitants of such county to the extent and upon such terms as may be agreed upon. NOW THEREFORE, in consideration of these facts, the parties hereto mutually covenant and agree as follows: 1. Scope of the Agreement: This agreement is for the provision of the use and privileges Grand Island Public Library to Hall County residents living outside the city limits of Grand Island. This Agreement’s cost to County will be: From October 1, 2016 through September 30, 2017, $15,000.00, payable in quarterly payments to Library. From October 1, 2017 through September 30, 2018, $20,000.00, payable in quarterly payments to Library. Quarterly payments due from County on January 1, 2017, April 1, 2017, July 1, 2017, October 1, 2017, January 1, 2018, April 1, 2018, July 1, 2018 and October 1, 2018. Payments shall be made to the City of Grand Island, Attn: City Finance Director, P.O. Box 1968, Grand Island, NE 68802. 3. County’s Obligations: County shall be responsible for making payments as set forth in paragraph 2. above, which payments are to cover all expenses related to issuing the non- resident library cards. 4. City’s Obligation: Payments received from County pursuant to this agreement shall be credited by City to City’s general fund. 5. Library’s Obligations: Commencing October 1, 2016 through September 30, 2018, Library shall provide the cards to be issued pursuant to this agreement. The cards provided pursuant to this agreement shall be issued to Hall County residents living outside the city limits of Grand Island (non-resident cards). These non-resident cards shall be issued at no cost to the cardholders. Except as provided in this Section 5, non- resident cards shall be issued for one full year, and with no common expiration date. There shall be no limit on the number of household cards issued or renewed during the term of this agreement. For purposes of this agreement, one household card shall represent all cards applied for and distributed to the head of a household and other members of that one household. Library will actively market information concerning the availability of non-resident cards to Hall County residents living outside the Grand Island city limits. Non-resident cards issued by Library pursuant to this agreement shall permit the holders of such cards the use and privileges of Library’s library services upon such terms and conditions as those applicable to residents of the City of Grand Island. Notwithstanding anything in this Agreement to the contrary, all non-resident library cards and the library use and privileges granted hereby shall terminate on September 30, 2018 unless this agreement is extended, renewed or replaced by a new agreement providing for extension of such library use and privileges to Hall County residents living outside the city limits of Grand Island. There shall be no charge to County for cards issued by Library to cardholders under the Wood River Rural Schools 21st Century Community Learning Center Grant until such time as that program has ended. Library shall report to County, on a quarterly basis, a count of all household cards issued during the preceding quarter to Hall County residents living outside the Grand Island city Grand Island Regular Meeting - 10/17/2016 Page 32 / 34 3 limits. The first quarterly report shall be due January 1, 2017, and thereafter on April 1, 2017, July 1, 2017, October 1, 2017, January 1, 2018, April 1, 2018, July 1, 2018 and October 1, 2018. 6. Governance. This agreement shall be co-governed by the Hall County Board of Supervisors, the Grand Island City Council, and the Library Board of the Grand Island Public Library. 7. Indemnification. The Parties hereto agree to indemnify and hold harmless each other from and against all losses, liability, expenses, damages and claims, including attorney’s fees, arising out of or resulting from the indemnifying party’s acts or omissions in performing under this agreement, except to the extent caused by negligent or willful act or omission of such other party. The Parties agrees to provide liability insurance to indemnify itself in the event that it becomes liable for the payment of a judgment based upon its acts or omissions, or the acts or omissions of its agents or employees in performing this agreement. 8. Modification. This agreement may be modified by written agreement of the Parties. 9. No Separate Entity. There shall be no separate legal entity created through this interlocal cooperative agreement. 10. Finances. This agreement shall be financed by the funds available to the Parties. 11. Term and Duration. This agreement shall become effective on October 1, 2016, and shall continue in force and remain binding through October 1, 2018. Negotiations for a renewal contract shall commence on or before September 1, 2018. NOW THEREFORE, in consideration of the covenants and obligations contained herein, Hall County and the City of Grand Island duly execute this agreement.
