Grand Island Regular Meeting - 11/4/2020 Page 6 / 57 Hall County Regional Planning Commission Wednesday, November 4, 2020 Regular Meeting Item 1 Smart Soil LLC Local Siting Permit - Hall County Staff Contact: Grand Island Regular Meeting - 11/4/2020 Page 7 / 57 Agenda Item # 4 PLANNING DIRECTOR RECOMMENDATION TO REGIONAL PLANNING October 22, 2020 SUBJECT: Proposed Site for Smart Soil Composting Operation located in the SE ¼ of 19- 11N-12W of the 6th P.M in Hall County Nebraska on 190th Road between Husker Highway and Old Potash Highway. Background: On October 14, 2020, Stephen, Mossman, with Mattson Ricketts Law Firm, submitted a requet on behalf of Smart Soil, LLC to the Hall County Board of Commissioners requesting that they process a local siting approval application for a solid waste processing facility. As part of that request, the Hall County Board has forwarded the application to the Regional Planning Commission for review and comments per state statute. The County Board forwarded the request at their meeting on October 27, 2020. This is located just to the northeast of the Grand Island Area Landfill operated by the City of Grand Island. The entire property is zoned A-1 Primary Agricultural Zone. Composting operations are specifically listed as Conditional Uses in the regulations. The County Board has issued a conditional use for this operation at this location with the approval of Resolution 19-236 on December 10, 2019. A copy of the Conditional Use Permit was submitted with this application. Per the Nebraska Local Siting Act (NRSS § 13-1703(3)) for a solid waste processing facility review of the proposed site by the planning commission is required prior to consideration of approval by the County Board. This meeting is the opportunity for the Planning Commission to review and comment on the proposed location as a composting site. An applicant for siting approval shall submit information to the city council, village board of trustees, or county board of commissioners or supervisors to demonstrate compliance with the requirements of this section regarding a solid waste disposal area or solid waste processing facility. Siting approval shall be granted only if the proposed area or facility meets all of the following criteria: (1) The solid waste disposal area or solid waste processing facility is necessary to accommodate the solid waste management needs of the area which the solid waste disposal area or solid waste processing facility is intended to serve; (2) The solid waste disposal area or solid waste processing facility is designed, located, and proposed to be operated so that the public health, safety, and welfare will be protected. The applicant shall provide an evaluation of the potential for adverse health effects that could result from exposure to pollution, in any form, due to the proper or improper construction, operation, or closure of the proposed solid waste disposal area or solid waste processing facility; (3) The solid waste disposal area or solid waste processing facility is located so as to minimize incompatibility with the character of the surrounding area and to minimize the effect on the value of the surrounding property. The city council, village board, or county board shall consider the advice of the appropriate planning commission regarding the application; (4) The plan of operations for the solid waste disposal area or solid waste processing facility is designed to minimize the danger to the surrounding area from fire, spills, or other operational accidents; (5) The traffic patterns to or from the solid waste disposal area or solid waste processing facility are designed to minimize the impact on existing traffic flows; and (6) Information regarding the previous operating experience of a private agency applicant and its subsidiaries or parent corporation in the area of solid waste management or related activities are made available to the city council, village board, or county board. If a corporation, a parent company or subsidiary thereof, or any officer or board member of the corporation or the parent company or subsidiary applying for approval has been convicted of a felony within ten years of the date the application is filed, site approval shall not be granted. There are several guidelines for this application set by statute. First, the public hearing required to be held before the Hall County Board of Supervisors cannot be held any sooner than ninety (90) days after filing, but no later than one hundred twenty (120) days after filing. We have that timeframe calendared for January 12, 2021 to February 11 , 2021. After the public hearing, the record needs to be held open for an additional thirty (30) days for written public comments to be filed. Finally by statute, final action by the Hall County Board of Supervisors shall be taken one hundred eighty ( 180) days after filing which is April 12, 2021. The legal description of the site is the Southeast Quarter of Section 19, Township 11N, Range 12 West in Hall County, Nebraska. The Owner of the facility is Smart Soil, LLC and is currently located at 7337 West Blender Road, Grand Island, Nebraska 68803. The Smart Soil compost facility will cover an area of approximately 45 acres. This facility, when in full production, will accept up to 100,000 cubic yards of mixed compost material annually. Most product will be generated in the Central Nebraska Region and consist of yard waste, paunch manure, municipal sludge, livestock waste, food waste, ground paper, cardboard, wood chips, crop residue, and other materials of organic origin. Grand Island Regular Meeting - 11/4/2020 Page 14 / 57 3 Neb. Rev. Stat. § 13-1703 Criteria: Neb. Rev. Stat. § 13-1703(1) -- The facility is necessary to meet the solid waste needs of the area: Accepted product will range from organic paper products, food waste, manure waste, and paunch. Most products do not currently have a good recycling process to where the material can be repurposed and reused as a viable product and Smart soil is attempting to provide a facility to help process and generate a marketable byproduct. Currently, paunch material is being hauled and dumped in landfills nearly 75 miles from the Grand Island area. Historically, this material has caused issues with the local community due to the improper handling of the product. Smart Soil, LLC is proposing this facility to properly handle and convert paunch and many other waste products into a viable byproduct and soil amendment. This site would be very beneficial to local industry in and around the Grand Island Area. Neb. Rev. Stat. § 13-1703(2) -- The facility is designed, located, and proposed to be operated so that the health, safety, and welfare of the local population will be protected. It will be necessary to quickly respond to all emergencies that could endanger the health and welfare of the employees or local members of the community. The facility is planned to have gravel surfaced roads to major portions of the site, so wet weather will have minimal effect on the ability to access the site in an emergency. Additionally, the facility will be constructed with compacted clay liners in all holding ponds and composting areas to minimize the potential for leachate to actively infiltrate directly to groundwater aquifers. Most importantly, surface water runoff will be controlled so that all rainfall within the footprint of the facility will be routed to the stormwater containment structures. Testing procedures and a quality assurance plan has been prepared to protect groundwater when implemented. Periodic inspections will be completed by State agencies to ensure compliance with solid waste processing facilities at a State and Federal level. Neb. Rev. Stat. § 13-1703(3) -- The facility is located to minimize incompatibility with the surrounding area and has been reviewed by the appropriate planning commission: The proposed facility is located just North of the existing Hall County landfill and situated on property that historically was grass pasture. It was recently transitioned to row crop and is surrounded by adjacent row crop fields. The proposed site plan outlines windbreaks that are located around much of the site along with berms that serve as containment for stormwater runoff. The exterior berms also serve as access roads for the facility and are positioned to best utilize the natural contour of the property. The application for local siting is being submitted to the Hall County Planning Regional Commission for review. Grand Island Regular Meeting - 11/4/2020 Page 15 / 57 4 Neb. Rev. Stat. § 13-1703(4) -- The plan minimizes danger from fire, spills, or other operational accidents: The exterior and interior roads provide ample access to all facility buildings and areas in case of a fire. The proposed site is in the jurisdiction of the Shelton Volunteer Fire Department. The telephone number is (308)647-6772. The travel distance to the site is about 10 miles. If a fire starts in a windrow, efforts will be taken to isolate the material to keep the fire from spreading. All material will be handled and processed within the limits of the facility so that any spills or accidents when handling raw waste material are contained by basins and a clay lined pond. Neb. Rev. Stat. § 13-1703(5) -- Traffic patterns are designed to minimize impact on existing traffic flows: Smart Soil, LLC will limit travel with loaded trucks to Husker Highway and Highway 11 between the facility and city limits of Grand Island. Temporary alternate routes may be sought by the applicant and approved by Hall County Highway Superintendent or County Engineer when needed. Consultation with the Hall County Highway Superintendent or County Engineer is necessary for routing deliveries of outgoing compost products and soil amendments. Husker Highway and Highway 11 are the approved truck routes in and around Grand Island. Turning lanes are not necessary off Husker Highway based on the current condition of the intersection. Site distance is appropriate and has been discussed with the Hall County Highway Superintendent. Neb. Rev. Stat. § 13-1703(6) – Previous operating experience of Applicant: Neither the Applicant nor any of its officers or shareholders have been convicted of a felony within ten (10) years of the day the Application is filed. The Applicant’s previous operating experience is as follows: The applicant, Smart Soil, LLC is owned and operated by Andrew Woitaszewski. Andrew has extensive knowledge of agricultural activities and the supporting science needed to operate and manage a successful farming operation, cattle feeding operation, and other land development activities. Andrew Woitaszewski is the owner of A & A Farms and A & A Feeders located Northwest of Grand Island. A & A Feeders is an open lot cattle feeding facility that requires very similar management of a clay lined holding pond. The proper permitting requirements and management decisions have provided Andrew with a firm understanding of waste management and proper land application of wastewater runoff. Applying runoff water to adjacent property at agronomics rates is critical to maintaining compliance as a permitted facility. PROPER SAFETY PRECAUTIONS FOR INSTALLATION IN DEEP TRENCHES SHALL BE FOLLOWED AT ALL TIMES. EARTH FILL OVER THE SEWER LINES SHALL BE COMPACTED TO THE SAME DENSITY AS IS REQUIRED IN ADJACENT FILL. 1.5 OTHER REQUIREMENTS 1.5.1 SEEDING ALL CUT AND FILL AREAS ABOVE THE CREST OF THE PERMANENT IMPOUNDMENT POOL AND OUTSIDE THE COMPOST PAD AREAS INCLUDING THE ENTIRE BACK SLOPE OF THE EMBANKMENT SHALL BE SEEDED TO PERENNIAL GRASS AS SPECIFIED BY THE PLANS. 1.5.2 CLEAN UP DURING CONSTRUCTION, THE CONTRACTOR SHALL KEEP THE WORK SITE, AREAS ADJACENT TO THE WORK SITE, AND ACCESS ROADS IN AN ORDERLY CONDITION. THIS PRACTICE WILL ALLOW FOR 6 INCHES OF THE EXISTING SOIL TO BE TILLED, ADJUST MOISTURE CONTENT, AND COMPACTED. THE REMAINING 6 INCHES OF LINER WILL BE INSTALLED IN 6 INCH LIFTS BY SCARIFYING THE PREVIOUS LIFT, ADJUSTING MOISTURE, AND COMPACTING. THE END PRODUCT MUST BE NO LESS THAN 12 INCHES OF COMPACTED SOIL LINER. ANY SIGNIFICANT LAYERS, POCKETS, OR SEAMS OF ROCK, GRAVEL, OR OTHER PERMEABLE MATERIAL ENCOUNTERED SHALL BE OVER-EXCAVATED AND REPLACED WITH A MINIMUM OF 12 INCHES OF WELL COMPACTED LOW PERMEABILITY MATERIAL, REGARDLESS OF THE AMOUNT OF LINER MATERIAL OVERLAYING THOSE AREAS. ONCE THE COMPACTED LINER HAS BEEN CONSTRUCTED, SASE WILL COORDINATE COLLECTION OF THE UNDISTURBED CORE SAMPLES AS DETERMINED BY ASTM D 1587 FOR SAMPLING, ASTM D 4220 FOR PRESERVING AND TRANSPORTING AND ASTM D 5084 FOR PERMEABILITY. THE FLOOR SAMPLES WILL BE COLLECTED FROM LOCATIONS SPACED ON A GRID OF APPROXIMATELY 210 FEET BY 210 FEET TO MAINTAIN THE ONE SAMPLE PER ACRE STANDARD. THE SIDE WALL SAMPLES WILL BE COLLECTED RANDOMLY AROUND THE STRUCTURE. THE MINIMUM NUMBER OF SAMPLES TO BE TAKEN FROM EACH NEW SOIL LINER FOR PERMEABILITY TESTING IS PROVIDED IN TABLE 2. STRUCTURE NAME HOLDING POND PERMEABILITY FLOOR SAMPLES 1 TABLE 2 - REQUIRED TEST QUANTITIES PERMEABILITY SIDEWALL SAMPLES 1 A MAP INDICATING THE LOCATION OF THE PERMEABILITY TEST SAMPLES WILL BE PROVIDED WITH THE CERTIFICATION OF THE FACILITY. SEEPAGE RATES WILL BE DETERMINED BY USING DARCY'S LAW BASED ON THE MAXIMUM DESIGN DEPTH, LINER THICKNESS, AND SATURATED HYDRAULIC CONDUCTIVITY. THE CORE SAMPLES WILL BE COLLECTED TO THE DESIGN LINER DEPTH TO VERIFY ITS CONSTRUCTED THICKNESS. SAMPLES WILL BE DELIVERED TO A SOIL-TESTING LABORATORY APPROVED BY THE ENGINEER FOR DETERMINATION OF PERMEABILITY OF THE CONSTRUCTED LINER. ALL TEST RESULTS WILL THEN BE FORMALIZED IN A REPORT DEVELOPED BY SASE AND SUBMITTED TO NDEE. IN THE EVENT THAT ONE OR MORE PERMEABILITY TESTS RESULT IN A CALCULATED SEEPAGE RATE OF MORE THAN 1/8 IN/DAY, THE FOLLOWING PROCEDURES SHALL BE FOLLOWED. A trial period was conducted to explore the suitability ofthe proposal at the proposed site. Feedback received through the trial period indicates the proposal, including the location site, are compatible with its proposed use. 7. NOW,THEREFORE,BE IT RESOLVED that the application for a conditional use permit for the conditional use of the above-described real estate for the above-stated uses should be and hereby is approved subject to the following conditions: Smart Soil LLC—Conditional Use Permit- Page 1 of 4 Grand Island Regular Meeting - 11/4/2020 Page 27 / 57 Term—This permit is intended to substantially coincide with Smart Soil LLC's Nebraska Department of Environment and Energy Operating Permit, but shall expire no later than December 31, 2026. The permit may be terminated if Applicant fails to comply with any of the conditions set forth herein. In the event ofnoncompliance,the Hall County Board of Supervisors shall notify Applicant in writing setting forth the areas ofnoncompliance. If Applicant fails to cure said noncompliance to the satisfaction of the Board within thirty(30)days after receiving said notice, the Hall County Board of Supervisors may suspend,revoke, or terminate this conditional use permit. In addition, the county may institute any appropriate action or proceeding to prevent, restrain, correct, or abate any breach, violation, or noncompliance. The remedies stated above are cumulative and in addition to any other remedies provided by law. Water and Regulatory Conditions: Applicant will comply with Nebraska Department of Environment and Energy(NDEE)rules, regulations, and conditions. Applicant will provide copies, within 30 days of receipt, of all construction and operating permits issued by NDEE to zoning officials. Applicant will provide any additional NDEE and zoning documentation upon request. Applicant will follow all Federal, State, County, and local laws, codes, and regulations. Applicant shall contain all water that that falls within the compost facility and maintain separation of such water from waters leaving the site via natural water ways. Applicant shall maintain natural drainage to and from the site at pre-development quantity and in substantially the same location. General Operating Conditions: Applicant may operate the site 7 days a week. Applicant shall not accept materials on Sundays, but may accept materials on any other day. Applicant will maintain the facility in a clean,neat, and orderly condition. Applicant shall not turn the compost materials on Saturdays, Sundays, and County Holidays from May 1 through October 1 of each year. Material Composition&Incorporation Conditions: Applicant shall limit composting to the Initial List of Components to be composted at the site for the first six months of operation to establish a baseline for odor control, fly control and traffic. Upon successful completion ofthe six month period and establishment of baseline expectations the applicant may add additional component by reporting the addition of those components to the zoning official and beginning a new six month control period to determine the impact on odor control, fly control and traffic generated. Travel Conditions: Applicant will ensure suppliers will limit east/west travel with loaded truck to Husker Highway between the western Hall County line to Highway 11 and between Highway 11 and the city limits of Grand Island,Nebraska. Temporary alternate routes may be sought by the applicant and approved by the Hall County Highway Superintendent/County Engineer Applicant shall consult with Hall County Highway Superintendent/County Engineer for routing deliveries of outgoing compost products. Public Hearing – Rezoning – Grand Island – Concerning a change of zone on property located at 4141 Montana Avenue Lot 13 of Northwest Gateway Subdivision in Grand Island, Hall County Nebraska from LLR Large Lot Residential Zone and RO Residential Office to Residential Office (C-02-2021GI) O’Neill opened the public hearing. Nabity explained the request is to amend the zoning of one lot on 4141 Montana Avenue. The lot is currently almost 50% LLR and RO this would confirm the RO zoning across the whole lot. The owner/developer of the lot Amos Anson is requesting the zone change for the south portion of lot 13. Nabity stated the RO zone does allow for more density of housing. The comprehensive plan does call for this area to the area to be developed with mixed use commercial. Bruce Bluhm, 3009 Colorado – Mr. Bluhm stated he was against the zone change. The area surrounding been established for years. Making the change will allow the developer to fill the area up with different style of housing. Mr. Bluhm also mentioned the area has a history of water problems. With the development and construction in the area will possibly cause more water problems. Amos Anson, 4234 Arizona Ave - Mr. Anson stated he is the owner of the 5 and half acres of land. Mr. Anson showed an overview of his plans. He explained his plan is not to build an apartment building. The homes are bigger in square footage than the Grand Island Regular Meeting - 11/4/2020 Page 33 / 57 surrounding homes. These would be attached single family homes built on the site. Joe Ferris, 3024 Idaho Ave – Mr. Ferris stated he was against the zone change. His concerns were high traffic, more activity, water issues and the change of atmosphere. Travis Ericson, 3020 Idaho Ave – Mr. Ericson explained his concerns with the zone change are water issues, traffic and change in their neighborhood. Would like the homes to look similar to the surrounding homes in the area. Barb Klein, 3030 Idaho Ave – Ms. Klein stated her concerns with the zoning change are water issues and added traffic to the area. O’Neill closed the public hearing. A motion was made by Ruge and second by Randone to recommend approval for the rezoning of 4141 Montana Avenue Lot 13 from LLR Large Lot Residential and RO Residential Office to RO Residential Office finding that the proposed changes are consistent with the comprehensive development plan and future land use map for the City of Grand Island and that this change will eliminate confusion regarding the zoning of this property. The motion carried with eight members voting in favor (Ruge, Nelson, Monter, Hendricksen, Robb, Rainforth, Rubio and Randone) and one abstaining (O’Neill). 6. Public Hearing – Zoning Text Amendments – Grand Island – Concerning changes to sections §36-8 Definitions and §36-22. Nabity explained the changes to the definitions will harmonize the definition of Street Frontage between the subdivision regulations and the zoning regulations.
