4. Final Plat –Prairie Creek Meadows Third- Grand Island- A Tract of Land
Consisting of all of Lots 3,4,5 and 6 of Prairie Creek Meadows Second
Subdivision in Hall County, Nebraska. Located south of One R Road and
west of Boxelder Drive. The final plat will result in 2 reconfigured lots from
the four lots as they currently exist. Ownership of the 4 lots is shared by 2
owner. The property is zoned PUD and will be used for residential
development.
5. Director’s Report Proposed Changes to the Grand Island Subdivision
and Zoning Regulations Staff has been working on changes to the
subdivision regulations that would reflect new and changing technologies
and methods of receiving and delivering information. Staff has also been
working on proposed changes to the telecommunications section of the
zoning regulations. These will be presented for discussion and input.

The meeting of the Regional Planning Commission was held Wednesday, November 6, 2019,
at City Hall – Grand Island, Nebraska. Notice of this meeting appeared in the "Grand Island
Independent" on October 26, 2019. Present: Pat O’Neill Leslie Ruge Tony Randone

1. Call to order.
Chairman O’Neill called the meeting to order at 6:00 p.m.
O’Neill stated that this was a public meeting subject to the open meetings laws of the State of Nebraska. He noted that the requirements for an open meeting are posted on the wall in the room and easily accessible to anyone who may be interested in reading
them.
O’Neill also noted the Planning Commission may vote to go into Closed Session on any agenda item as allowed by State Law.
The Commission will discuss and may take action on any item listed on this agenda.

2. Minutes of the September 4, 2019 meeting.
A motion was made by Randone and second by Maurer to approve the minutes
of the October 2, 2019 meeting.
The motion carried with eight members in favor (O’Neill, Ruge, Nelson, Maurer,
Rubio, Monter, Hendricksen and Randone) and one member abstaining (Kjar).
3. Request Time to Speak.
No requests were made.
4. Election of Officers.
Nabity mentioned the current officers are Chair - Pat O’Neill, Vice Chair – Jaye
Monter, and Secretary – Les Ruge.
A motion was made by Randone and second by Rubio to keep the same officers.

The motion carried with ten members voting in favor (O’Neill, Nelson, Ruge, Maurer,
Robb, Monter, Rubio, Hendricksen, Randone and Kjar and no members voting no.
5. Public Hearing Redevelopment Plan Grand Island Area 2 Bosselman Kings Crossing – Concerning an amendment to the redevelopment plan for CRA Area No. 2
for lot 2 of the King’s Crossing Subdivision located south of Husker Highway and west
of Locust Street. The request from Bosselman Pump and Pantry Inc. calls for redevelopment Lot 2 of King’s Crossing Subdivision for a latest generation Pump and
Pantry Convenience Store and associated accessory uses.
O’Neill opened the public hearing.
Nabity stated the Pump and Pantry new generation convenience store would go in front
of the hotel. TIF will be used to help pay for the accusation for that property. The area
is planned for commercial development. The property was part of the blight study for
the CRA Area #2 in 1997/1998 and redone in 2000 because of changes in the state
statute. The comprehensive plan does call for commercial development in that area so it is consistent with the comprehensive plan.
No members of the public spoke at the hearing. Gus Patsios was available for
questions from the commission.

A motion was made by Hendricksen and second by Ruge to approve Resolution 2020-
02 and recommend approval The Redevelopment Plan Grand Island Area 2 for
Bosselman Kings Crossing finding that it conforms to the comprehensive plan for the
City.
The motion carried with ten members in favor (Nelson, O’Neill, Ruge, Maurer, Robb,
Monter, Kjar, Rubio, Randone and Hendricksen) and no members voting no.
6. Public Hearing Redevelopment Plan Grand Island Area 17 Prataria Ventures Prairie Commons Phase 2 – Concerning an amendment to the redevelopment plan for CRA Area No. 17 for Phase 2 of the Prairie Commons development. The request from
Prataria Ventures LLC calls for redevelopment of 3 lots west of Prairie View Street south
of Husker Highway for office uses.
O’Neill opened the public hearing.
Nabity stated Prataria is looking in developing the three lots west of the hospital for offices
uses. The area is zoned RO – Residential Office planned for mixed use commercial. TIF
will be used for utilities and grading. The project is consistent with the comprehensive plan.
No members of the public spoke at the hearing.
O’Neill closed the public hearing.
A motion was made by Maurer and second by Nelson to approve Resolution 2020-03 and approve the Redevelopment Plan CRA Area No. 17 for Phase 2 of the Prairie
Commons development finding that it conforms to the comprehensive plan for the City.
The motion carried with ten members in favor (Nelson, O’Neill, Ruge, Maurer, Robb, Monter, Kjar, Rubio, Randone and Hendricksen) and no members voting no.
7. Preliminary and Final Plat – Ellington Pointe – Grand Island - A tract of Land
consisting of all of Lot 2 Hanover Second Subdivision, all of Lots 2 and 4 of Hanover Third Subdivision all in Grand Island, Hall County, Nebraska. Located south of 13th Street
and west of North Road.

Rashad Moxey stated the property consists of 42 lots on 14 acres. The property is zoned R-
3 Medium Density Residential and R1 – Suburban Density Residential. The development
of this subdivision will aid the city in extending sewer services to the existing homes south
of this development. The project is consistent with the comprehensive plan and the existing zoning.
A motion was made by Randone and second by Robb to approve the preliminary and
final plat for Ellington Pointe Subdivision.
The motion carried with ten members in favor (Nelson, O’Neill, Ruge, Maurer, Robb,
Monter, Kjar, Rubio, Randone and Hendricksen) no members voting no.
8. Director’s Report.
January meeting will be moved to January 8, 2020 Nabity talked about the NPZA Fall Workshop he attended in Nebraska City.

SUBDIVISION AGREEMENT
PRAIRIE CREEK MEADOWS THIRD SUBDIVISION
(Lots 1 and 2)
In the County of Hall, Nebraska
The undersigned, Thomas J. Wald, a single person and Travis J. and Crystal L, a
married couple, hereinafter called the Subdivider, as owners of a tract of land comprising:
All of Lots 3,4, 5 and 6 of Prairie Creek Meadows Subdivision in Hall County Nebraska.
as a subdivision of the foregoing tract of land located within the jurisdiction of Hall County,
Nebraska, and hereby submits to the County Board of Supervisors of such County for acceptance
as provided by law an accurate map and plat of such proposed subdivision, to be known as
PRAIRIE CREEK MEADOWS THIRD SUBDIVISION , designating explicitly the land to be
laid out and particularly describing the lots, easements, and streets belonging to such subdivision,
with the lots designated by number, easements by dimensions, and streets by name, and proposes
to cause the plat of such subdivision when finally approved by the Regional Planning
Commission and the County Board to be acknowledged by such owner, certified as to accuracy
of survey by a registered land surveyor, and to contain a dedication of the easements to the use
and benefit of public utilities, and of the street to the use of the public forever. In consideration of
the acceptance of the plat of said PRAIRIE CREEK MEADOWS THIRD SUBDIVISION, the
Subdivider hereby consents and agrees with the County of Hall, Nebraska, as follows:
1. Planned Unit Development Zone. This subdivision is designated as a
Planned Unit Development Zone and shall be regulated in accordance with the Hall County Zoning

Resolution. A Development Plan as shown on the Final Plat for PRAIRIE CREEK MEADOWS
THIRD SUBDIVISION as filed with the Hall County Register of Deeds. Any amendments to such
Development Plan shall be approved by Hall County in accordance with the Hall County Zoning and
Subdivision Regulations.
2. Roads. Box Elder Drive shall be permitted as private road to be maintained
by the Subdivider and/or future property owners. The intersection of Box Elder Drive shall be
designed to specifications approved by the Hall County Engineer.
3. Water. A public water supply is not available to the subdivision and the
subdivider agrees that each lot will be served by individual wells. Based on information available,
water quality and quantity should be sufficient for household use. Availability, adequacy, quality
and quantity of water is not guaranteed by the County and the County does not hold any
responsibility for provision of water to lots created in this subdivision.
4. Sanitary Sewer. Each lot shall be served by individual on site waste-water
treatment systems as approved by the State of Nebraska.
5. Storm Drainage. The Subdivider agrees to grade all lots in the subdivision in
conjunction with the development proposed thereon so that storm drainage is conveyed to a public
right-of-way or to other drainage systems. Storm drainage shall not be permitted to back onto
adjoining properties. Storm drainage shall be built to specification and designs approved by the Hall
County Engineer.
8. Driveway Access. Vehicular access from the lots shall only be permitted onto
One-R Road at the intersection of One-R Road and Box Elder Drive.

9. Design and Construction. No building shall be constructed within the
Subdivision except within the setbacks as defined in the A-1 Primary Agriculture Zone for non-farm
residences.
11. Flood Plain Since the subdivision is within a flood plain as delineated from
the best information available from the Nebraska Department of Natural Resources, all structures
constructed shall have the lowest floor elevation to a minimum of one foot above the elevation of the
100-year flood as determined by the building permit received by the Subdivider or successors from
the County Building Department. No basement shall be constructed in connection with any structure
in the flood plain unless such basement is floodproofed and certified as such by a qualified engineer
or architect.
12. Engineering Data. All final engineering plans and specifications for public
improvements shall bear the signature and seal of a registered professional engineer and shall be
furnished by the Subdivider to the Department of Public Works for approval prior to contracting for
construction of any improvements. Inspections of public improvements under construction shall be
performed under the supervision of a professional registered engineer and upon completion shall be
subject to inspection and approval by the Department of Public Works prior to acceptance by the
County of Hall. An "as built" set of plans and specifications including required test results bearing
the seal and signature of a registered professional engineer shall be filed with the Director of Public
Works by the Subdivider prior to acceptance of these improvements by the County.
13. Warranty. The undersigned owner, as Subdivider, warrants that it is the
owner in fee simple of the land described and proposed to be known as PRAIRIE CREEK

MEADOWS THIRD SUBDIVISION , and that an abstract of title will be submitted for examination,
if necessary, upon request of the County of Hall.
14. Successors and Assigns. This agreement shall run with the land and shall be
binding upon and inure to the benefit of the parties hereto, their successors, assigns, heirs, devisees,
and legatees. Where the term "Subdivider" is used in this agreement, the subsequent owners of any
lots in the subdivision shall be responsible to perform any of the conditions of this agreement if the
Subdivider has not performed such conditions.
