Or an odd month? After record-breaking supply in October, the first week of November featured the Presidential election which curtailed supply for the week. This week we had a mid-week holiday with Veterans Day on Wednesday. Thank you to all who served. The holiday also slowed supply for the week. After $72Bln in supply for October, we have only seen $5Bln price in the first two weeks of November, with next week the only full week left in the month before the Thanksgiving holiday week. With the lack of supply we did see a little tightening with credit spreads; let’s see how long that lasts. While we have been sitting around $6Bln on the 30-day visible supply calendar, the last two days saw that jump up by $10Bln. We expect a busy December similar to what we have seen in the past. The yield curve flattened, as a vaccine would lessen the need for accommodative Federal Reserve policy. However, COVID cases continue to rise quickly and many cities and states are increasing restrictions. While the intermediate-term economic outlook has improved, the short-term outlook remains cautious, and various Federal Reserve speakers mentioned this. We believe that the Fed is concerned that the intermediate-term economic optimism will cause rates to rise too quickly, especially when current economic conditions are so weak. It is refreshing to write a rates commentary that leaves politics out. We will expect that to resume as we get closer to the Georgia Senate runoff election. This is the site of the former Amigos. The space was a restaurant previously (Amigos) but did not have a liquor license. The proposed business name is Chuckwagon BBQ and Pizza. The application is for a Class I Liquor License; beer, wine, distilled spirits, as on sale only. I noted on the application forms that Roebuck disclosed a couple moving violations, all traffic infractions. The listed manager of the new location, Esmarelda (Esme) Castorena, disclosed one motor vehicle accident and indicated no moving violations associated. I checked Roebuck and Esme through both Spillman and NCJIS. I found some noteworthy entries in Spillman (local) records,namely, numerous civil disputes and entries for paper service by the Hall Co Sheriff. however, upon reading further, I found that all of those civil or paper service entries were due to Roebuck Jr owning many properties in Grand Island, and landlord/tenet issues. I also found that both subjects have valid Nebraska drivers licenses. I found that neither of them have any outstanding criminal warrants for their arrest. I also checked Larry and Esme through a paid Law Enforcement Only database, which tends to provide mostly identifying information and details of any involved civil issues. I noted nothing of significance. I did find that Roebuck Jr is, or has been, the owner of many other businesses, and has been issued a Liquor License previously. Roebuck was last approved, after investigations, in 2013. I did not search any records prior to that year. On 12-10-20, at 1300, I met with NSP Investigator Jeromy McCoy at the business. Larry Roebuck Jr was waiting there, and Esme Castorena also responded to speak with us. Roebuck advised that all his properties are under the ownership of his LLC Chuckwagon Enterprises. He said he has already invested a large amount of money in refurbishing the building and parking lot. Larry Jr pointed out that he also owns the Sonic Drive In further north on Locust, many other properties in Grand Island, and Chucks 2.0 restaurant in Aurora. McCoy covered Commission concerns and questions. Both subjects advised they have prior liquor sales experience, as Esme was the manager of other Roebuck enterprises in Grand Island, Sam and Louie's, and Flippin Chicken. Larry Jr said their plan is to be open seven days a week. He said the business hours will be 1100-2300. The business plan is to eventually have approximately 20 employees, with the bulk of those rotating on a part-time basis. Roebuck said he is aware that minors under 19 years of age cannot serve alcohol, and plans to have someone over 21 on duty at all times to dispense any alcohol purchased. Larry Jr advised he has no current outstanding civil actions against him, and does not have any undisclosed violations or convictions. While collection pipes within the system can handle the higher temperature, this revision to Chapter 30 will limit discharge of any liquid or vapor entering sensitive components and pumps within the wastewater system from exceeding 40o Celsius (104o Fahrenheit). Notice of the meeting was given in The Grand Island Independent on December 16, 2020. Mayor Roger G. Motion adopted. #2020-BE-6 - Consideration of Determining Benefits for Vehicle Off-Street Parking District #3. Finance Director Patrick Brown reported that the creation of Parking District #3 occurred January 8, 2019. Property owners within the District will be charged a special assessment based on the entire square footage of their buildings. Property owners who have parking within their property that is open to the public, customers or users of building can apply for a $10/space credit. There is an estimated $13,000 in potential parking spot credits based on estimated property owners owned parking spots. The Board of Equalization will approve the special assessments at their full amounts, as stated in the BOE resolution. If a credit is requested prior to billing then the net amount will be billed. If a credit is requested after the bill has been sent, but prior to the bill becoming delinquent the credit will be applied and a new bill can be generated. Staff recommended approval. Travis Spiehs, 110 West 2nd Street questioned his parking assessment inside his building which was not for public use. Motion by Schutz, second by Nickerson to approve Resolution #2020-BE-6. Utilities Director Tim Luchsinger reported that acquisition of a utility easement located at 1039 North Gunbarrel Road was in order to have access to install, upgrade, maintain, and repair power appurtenances, including lines and transformers. Martin Acres Subdivision and McLaughlin Manors Subdivisions electrical system was in need of upgrading. The proposed easement would allow the Utilities Department to install, access, operate and maintain the electrical infrastructure at this location. Staff recommended approval. No public testimony was heard. Public Hearing on Amendment to the Redevelopment Plan for CRA No. 2 located at 1201 South Locust Street (Ray O’Connor). Regional Planning Director Chad Nabity reported that in 2000 the Grand Island City Council declared property referred to as CRA Area 2 as blighted and substandard and approved a generalized redevelopment plan for the property. Raymond O’Connor representing the entities that own the Fonner View Center at 1201 S. Locust had submitted an application for tax increment financing to aid in the redevelopment of the property. The redevelopment plan amendment specifies that the TIF would be used to offset allowed costs for acquisition, redevelopment and renovation of the commercial building at this location. The cost benefit analysis included in the plan finds that this project meets the statutory requirements for an eligible TIF project. The bond for this project would be issued for a period of 15 years. The proposed bond for this project will be issued in the amount of $549,200. Staff recommended approval. No public testimony was heard. Public Hearing on Re-Adoption of the Grand Island Zoning Map. Regional Planning Director Chad Nabity reported that over the course of 20 years the City of Grand Island had periodically readopted the official zoning map for the City. Chad explained a proposal to re-adopt the City of Grand Island Zoning map was brought forward every 18 months or 2 years. The city of Grand Island occasionally re-adopts the zoning map incorporating all changes since the last re-adoption of the entire map along with changes as recommended. Staff recommended approval. Two proposed Ordinances for consideration were submitted. The first Ordinance changes the hours of alcohol sales for Sundays from noon to 9:00 a.m. would apply to all alcohol sales. The second Ordinance would only change the hours of sale for on-site consumption of alcohol from noon to 9:00 a.m. Staff made no recommendation. Brent Lindner, 1322 West John Street spoke in support. Police Chief Robert Falldorf stated it was their recommendation to not change the hours of sale for alcohol. He explained the calls for service were high on the weekends due to DUI’s. If the council was going to change the hours he would rather see option (B) approved for on sale consumption only. A lengthy discussion was held by Council regarding the pros and cons of changing the hours of alcohol sales. Motion by Paulick, second by Haase to approve Ordinance #9811 (A). Interim City Attorney Stacy Nonhof reported that on June 14, 2014, Van Kirk Brothers Contracting of Sutton, Nebraska was awarded a contract for Sanitary Sewer District No. 528 and 530T in the amount of $3,374,118.70. In November 2014, Van Kirk Brothers submitted a proposed Change Order in the amount of $827,456.82 for claimed extra work by the subcontractor Iowa Trenchless. That Change Order was denied for various reason. Since that time, a lawsuit was filed against the City by the subcontractor, Iowa Trenchless, and subsequently dismissed. A separate threatened action by Iowa Trenchless had been pending since May 2019. On December 16, 2020, the Claimant, the City, and the City’s liability insurance carrier participated in mediation of the claim. A settlement agreement was reached whereby the Claimant would execute a full and complete release of the City of Grand Island from all claims arising out of the denied Change Order and Claimant’s individual claims, in consideration of $75,000 to be paid by the City. Maintenance responsibilities for State highways within the corporate City limits are defined by state statute. The Nebraska Department of Transportation (NDOT) is responsible for the surface maintenance costs of the originally constructed highway lanes through a community and the City is responsible for the surface maintenance costs of any highway widening including parking, additional thru lanes, and dedicated turn lanes. NDOT performs snow removal on NE Highway 2, US Highway 281, US Highway 34, and the portion of US Highway 30 west of Johnstown Road. The City performs snow removal on US Highway 30 from Johnstown Road through town to the east City limits at Shady Bend Road. The statutes provide that the NDOT is to reimburse the City for work the City performs on NDOT’s highway lanes and the City is to reimburse NDOT for snow removal on State Highways within the City Limits. Discussion The maintenance agreement requires the City to certify that it has completed the maintenance work required by the agreement for the 2020 calendar year. Proposed improvements include 4 specific locations where the clay tile sanitary sewer main has cracked and crushed into an oval shape. The amendment is to provide final design, bidding, construction administration and observation (RPR) services. SCOPE OF SERVICES: 3 PHASE 3: FINAL DESIGN & BIDDING ASSISTANCE 3.1 FINAL DESIGN a. Utility Coordination i. Determine Initial Utility Conflicts: ii. Based on the topographic survey base map and proposed sewer improvements, determine likely conflicts with existing utilities. In the system, there are a total of 4 UV banks, which disinfect effluent water. This system was installed in 2004 and is in need of update to the self-cleaning system which involves replacing the drive cylinder, cleaning canisters and drive bar mechanism. Wastewater Division staff plan to do one (1) bank per year over the next three (3) years to the complete the updates. Discussion The City of Grand Island is required to meet State mandated disinfection standards on the treated effluent from the Wastewater Treatment Plant annually May through September. The City UV disinfection is a Trojan UV3000 Plus system which is using the UV disinfection lamps to inactivate pathogens, such as E. coli, before discharging the effluent. Currently, UV disinfection banks are a combination of Trojan and an off brand manufacturer. Over the years, we have experienced operation and maintenance issues using non-Trojan pieces in the Trojan UV disinfection system. Different manufactures offer varied life expectancy and intensity which is key to the UV disinfection process. MC2 Inc. of Omaha, Nebraska is the secured territory vendor of Trojan UV parts, materials, and service for the Trojan UV system. We are requesting that MC2 Inc to be designated as the sole source provider for Trojan UV parts, materials, and service. This would allow the plant to optimally operate and maintain the UV system. At this time the cost to provide the updates to the self-cleaning system are estimated at $38,140.17. The equity in the property is in excess of the lien amounts held by both the City and the bank. Discussion A new lien in the amount of $106,200.00 with Wells Fargo Bank, N.A. would by law be junior in priority to the City’s lien; however, Wells Fargo Bank, N. A., has asked the City to subordinate its Deed of Trust to the new Deed of Trust. ALTERNATIVES It appears that the Council has the following alternatives concerning the issue at hand.
