MINUTES OF CITY COUNCIL REGULAR MEETING
November 25, 2014
Pursuant to due call and notice thereof, a Regular Meeting of the City Council of the City of
Grand Island, Nebraska was conducted in the Council Chambers of City Hall, 100 East First
Street, on November 25, 2014. Notice of the meeting was given in The Grand Island
Independent on November 19, 2014.
Mayor Jay Vavricek called the meeting to order at 7:00 p.m. The following City Council
members were present: Linna Dee Donaldson, Chuck Haase, Julie Hehnke, Mitch Nickerson,
Peg Gilbert, John Gericke, Mark Stelk, Mike Paulick, and Vaughn Minton. The following City
Officials were present: City Administrator Mary Lou Brown, City Clerk RaNae Edwards,
Treasurer and Finance Director Jaye Monter, City Attorney Robert Sivick, and City Engineer
and Public Works Director John Collins.
INVOCATION was given by Pastor Steve Warriner, Abundant Life Christian Center, 3411 West
Faidley Avenue followed by the PLEDGE OF ALLEGIANCE.
Mayor Vavricek introduced Community Youth Council member Regan Dimmitt.
PRESENTATIONS AND PROCLAMATIONS:
Recognition of Stuhr Museum. Mayor Vavricek recognized Stuhr Museum and their upcoming
Christmas events. Executive Director Joe Black introduced Foundation Executive Director Kevin
Hendrix, Jennifer & Herb Worthington and Marketing Director Mike Bockoven.
Recognition of Salvation Army. Mayor Vavricek recognized the Salvation Army for their
outstanding and dedicated work in Grand Island. Captains William and Ann Mealy were present
for the recognition.
Recognition of Grand Island Wastewater Department Awards at Fall Conference. Mayor
Vavricek recognized the Grand Island Wastewater Department for receiving the NWEA Safety
Award and the Scott Wilbur Award during the Fall Conference in Kearney. Public Works
Director John Collins, Wastewater Treatment Superintendent Marvin Strong, Dr. Jue Zhao and
Dawn Slauter were present for the recognition.
PUBLIC HEARINGS:
Public Hearing on Request from El Castillo LLC dba El Castillo, 123 East South Front Street for
a Class “I” Liquor License. This item was pulled from the agenda at the request of the
applicant’s attorney John Higgins.

Public Hearing on Request from Joel Poppe dba Lucky 7 Saloon, 418 West 4th Street for a Class
“C” Liquor License. This item was pulled from the agenda at the request of the applicant, Joel
Poppe.
Public Hearing on Request from Casey’s Retail Company dba Casey’s General Store #2732,
4150 West Highway 30 for an Addition to Class “B-71404” Liquor License. City Clerk RaNae
Edwards reported that an application for an addition to Class “B-71404” Liquor License had
been received from Casey’s Retail Company dba Casey’s General Store #2732, 4150 West
Highway 30. Ms. Edwards presented the following exhibits for the record: application submitted
to the Liquor Control Commission and received by the City on November 3, 2014; notice to the
general public of date, time, and place of hearing published on November 15, 2014; notice to the
applicant of date, time, and place of hearing mailed on November 3, 2014; along with Chapter 4
of the City Code. Staff recommended approval contingent upon final inspecitoins. No public
testimony was heard.
Public Hearing on Acquisition of Permanent Easement for South Blaine Street Bridge
Replacements; Project No. 2014-B-1 (William H. Baasch). Public Works Director John Collins
reported that acquisition of a permanent easement was needed for the South Blaine Street Bridge
Replacements in order to allow for drainage. Staff recommended approval. No public testimony
was heard.
Public Hearing on Acquisition of Public Utility Easement for Hall County Sanitary Sewer
District 2 (SID 2) [Bockmann]. Public Works Director John Collins reported that acquisition of a
public utility easement was needed for the Hall County Sanitary Sewer District 2. The easement
would allow for construction, operation, maintenance, extension, repair, replacement and
removal of public utilities within the easement. Staff recommended approval. No public
testimony was heard.
ORDINANCES:
Councilmember Gilbert moved “that the statutory rules requiring ordinances to be read by title
on three different days are suspended and that ordinances numbered:

#9511 - Consideration of Amendment to the City of Grand Island, Nebraska Firefighters'
Retirement System Plan

be considered for passage on the same day upon reading by number only and that the City Clerk
be permitted to call out the number of these ordinances on second reading and then upon final
passage and call for a roll call vote on each reading and then upon final passage.”
Councilmember Nickerson seconded the motion. Upon roll call vote, all aye. Motion adopted.

#9511 - Consideration of Amendment to the City of Grand Island, Nebraska Firefighters'
Retirement System Plan
Finance Director Jaye Monter reported that Nebraska State Statutes changed regarding the Police
Officers’ and Firefighters Retirement System Plans due to the passage of LB 759. Changes
included “Sex-Neutral Basis” for “pre-84s”, minimum benefits for “pre-84” and annual reporting
requirements.
Motion by Gilbert, second by Donaldson to approve Ordinances #9510 and #9511.
City Clerk: Ordinances #9510 and #9511 on first reading. All those in favor of the passage of
these ordinances on first reading, answer roll call vote. Upon roll call vote, all voted aye. Motion
adopted.
City Clerk: Ordinances #9510 and #9511 on second and final reading. All those in favor of the
passage of these ordinances on second and final reading, answer roll call vote. Upon roll call
vote, all voted aye. Motion adopted.
Mayor Vavricek: By reason of the roll call votes on first reading and then upon final passage,
Ordinances #9510 and #9511 are declared to be lawfully adopted upon publication as required by
law.
#9512 - Consideration of Salary Ordinance Minimum Wage Legislation
Finance Director Jaye Monter reported that due to the passage of Initiative 425, Nebraska
Minimum Wage Increase, at the November 4, 2014 General Election a Salary Ordinance
amendment was required. Changes were needed to the pay ranges for the Library Page and
Seasonal/Temporary Workers.
Motion by Paulick, second by Minton to approve Ordinance #9512 on first reading.
City Clerk: Ordinance #9512 on first reading. All those in favor of the passage of this ordinance
on first reading, answer roll call vote. Upon roll call vote, all voted aye. Motion adopted.
City Clerk: Ordinance #9512 on second and final reading. All those in favor of the passage of
this ordinance on second and final reading, answer roll call vote. Upon roll call vote, all voted
aye. Motion adopted.
Mayor Vavricek: By reason of the roll call votes on first reading and then upon final passage,

CONSENT AGENDA: Mayor Vavricek stated he had a conflict of interest with item G-5.

Utilities Department with Leetch Tree Service of Grand Island, NE in an Amount of
$142,265.00.
#2014-347 - Approving Bid Award for Contract # 14-PCC-02 - Purchase of Substation Power
Transformer with WEG Electric Corporation of Duluth, GA in an Amount of $636,650.00.
#2014-348 - Approving 5 Year Lease Agreement for Billboard with Tri-City Sign Company
located at 2410 So. Webb Road in an Amount of $1,200.00 per year. The meeting was turned
over to Council President Chuck Haase.
Motion by Paulick, second by Nickerson to approve Resolution #2014-348. Upon roll call vote,
all voted aye. Motion adopted.
Mayor Vavricek resumed the meeting.
#2014-349 - Approving State Bid Award for One (1) 2015 Chevrolet Traverse All Wheel Drive
for the Engineering Division of the Public Works Department with Sid Dillion of Wahoo, NE in
an Amount of $24,933.00.

applicant’s attorney John Higgins.
#2014-358 - Consideration of Request from Joel Poppe dba Lucky 7 Saloon, 418 West 4th Street
for a Class “C” Liquor License. This item was pulled from the agenda at the request of the
applicant, Joel Poppe.
#2014-359 - Consideration of Request from Casey’s Retail Company dba Casey’s General Store
#2732, 4150 West Highway 30 for an Addition to Class “B-71404” Liquor License. This item
was related to the aforementioned Public Hearing.
Motion by Gilbert, second by Hehnke to approve Resolution #2014-359. Upon roll call vote, all
voted aye. Motion adopted.
PAYMENT OF CLAIMS:
Motion by Donaldson, second by Gericke to approve the Claims for the period of November 13,
2014 through November 25, 2014, for a total amount of $4,650,271.98. Unanimously approved.

Election of City Council President
The City Council is required to elect one Councilmember to the office of Council President. The term is
for a one-year period. The Council President automatically assumes the duties of the Mayor in the event
that the Mayor is absent or otherwise unable to fulfill his/her duties. Nebraska law allows the election of
the Council President to be by secret ballot. The total number of votes for each candidate; however, must
be stated and recorded in the Minutes. Past practice has included a run-off election between the top two
nominees, if necessary. The City Clerk will prepare, distribute, and count ballots. Nominations to fill the
vacancy are in order. A second is not required on nominations.

Background
Section 4-2 of the Grand Island City Code declares the intent of the City Council
regarding liquor licenses and the sale of alcohol.
Declared Legislative Intent
It is hereby declared to be the intent and purpose of the city council in adopting
and administering the provisions of this chapter:
(A)To express the community sentiment that the control of availability of alcoholic
liquor to the public in general and to minors in particular promotes the public
health, safety, and welfare;
(B)To encourage temperance in the consumption of alcoholic liquor by sound and
careful control and regulation of the sale and distribution thereof; and
(C)To ensure that the number of retail outlets and the manner in which they are
operated is such that they can be adequately policed by local law enforcement
agencies so that the abuse of alcohol and the occurrence of alcohol-related crimes
and offenses is kept to a minimum.
Discussion
Estanislao LLC dba La Cocina Mexican Restaurant, 2418 N. Webb Road, Suite A has
submitted an application for a Class “I” Liquor License. A Class “I” Liquor License
allows for the sale of alcohol on sale inside the corporate limits of the city.
City Council action is required and forwarded to the Nebraska Liquor Control
Commission for issuance of all licenses. This application has been reviewed by the Clerk,
Building, Fire, Health, and Police Departments.

Also submitted with the application was a request from Gabriella Gutierrez, 112 West 1st
Street, McCook, NE for a Liquor Manager Designation.
After reviewing the Police Department report (see attached) it is recommended that the
Council deny this request due to a false application, character and reputation issues with
Gemelo Mario Leon-Garcia, spouse of Gabriella Gutierrez, along with hidden ownership.
Alternatives
It appears that the Council has the following alternatives concerning the issue at hand.
The Council may:
1.Approve the application.
2.Forward to the Nebraska Liquor Control Commission with no
recommendation.
3.Forward to the Nebraska Liquor Control Commission with recommendations.
4.Deny the application.
Recommendation
Based on the Nebraska Liquor Control Commission’s criteria for the approval of Liquor
Licenses, City Administration recommends that the Council deny this application.

Only) LLC Retail Liquor License for "La Cocina Mexican Restaurant" from
Estanislao Gutierrez. I also Received a Copy of a Liquor Manager
Application from Gabriela Gutierrez for La Cocina. According to the
applications, Estanislao is married to Maria de la luz Valdez. Maria
signed a Spousal Affidavit of Non Participation form. Gabriela is married
to Gemelo Mario Leon-Garcia. Gemelo did not sign a Spousal Affidavit of
Non Participation form. According to ICE, Gemelo is an illegal alien who
falls under an executive order by President Obama called DACA, which
stands for Deferred Action Childhood Arrival. Under President Obama's
order, Gemelo's status hasn't changed. He is still an illegal alien, he
is just shielded from deportation while President Obama is in office. A
new president could rescind the order.
While perusing the applications, I made the following observations. None
of the four people listed on the applications disclosed any convictions.
Gemelo lent money to Estanislao to establish and/or operate the business.
Gemelo is listed as having access to the business account. The lease
agreement for the restaurant was also witnessed by "Gemelo M Leon G."
There is a discrepancy in the spelling of Gabriela's name. In most places
on the applications, it's spelled "Gabriella." In other places, her name

is spelled, "Gabriela." I found that it's spelled with one "l" on all the
accompanying legal identifying documents and in front of a notary where a
signature was required. Estanislao moved to McCook, NE is 2010. He bought
the La Cocina there and eventually opened a La Cocina in Beatrice and
York. The Beatrice store closed. Prior to living in Nebraska, he and the
other applicants have lived in Tennessee and Kansas.
I checked all of the people on the applications through Spillman (GIPD
database) and the Nebraska Criminal Justice Information System (NCJIS).
None of the people were listed in Spillman which isn't surprising since
they are relatively new to Nebraska and don't live in Grand Island.
According to NCJIS, Gabriela has two convictions for speeding in Nebraska
in 2013. Gemelo has an incident where he was convicted of speeding and no
operator's license in April of 2014, a conviction for not having
insurance, and a second incident of being convicted for not having a
driver's license and speeding in 2012. Estanislao just has an entry in
NCJIS for having a driver's license. I can't find Maria in NCJIS. I also
checked NCJIS for wages earned by running each person's Social Security
number. Gabriela is the only person reporting wages earned in Nebraska.
None of the applicants have any outstanding arrest warrants that I can
find, and it appears that Gabriela and Estanislao are the only applicants
with a valid driver's license.
Besides the Spillman and NCJIS checks, I checked on the applicants by
using a paid law enforcement-only database. I found all of the
applicants, but there was very little information on any of them. I
called the McCook Police Department and sent a request for information to
the Franklin, Tennessee Police Department. Results of those contacts will
be discussed later in this report. Nebraska State Patrol Investigator Dan
Fiala and I met with Gabriela and Estanislao at the property for the
restaurant on 12/1/14 at 1000 hours. Gabriela said that her husband,
Gemelo, is living in York and managing the restaurant there while she has
been living in McCook. She said Gemelo does a lot of driving back and
forth. It's worth noting again that Gemelo does not have a valid driver's
license. Gabriela also said that Gemelo has a twin brother named Ismael.
Ismael is supposed to manage the McCook restaurant when Gabriela moves to
Grand Island to manage the restaurant here. It was pointed out to
Gabriela that none of the people listed on the application disclosed any
convictions. She said that they didn't think traffic convictions were
supposed to be included. Investigator Fiala went over the application
with her and read the question which specifically says, "Include traffic
violations." Gabriela advised that her husband (Gemelo) filled out the
application.
Gabriela was asked how much money Gemelo lent the business for the Grand
Island store. Gabriela looked surprised and asked Estanislao (her
father). Neither one of them knew. It seemed odd to me that Gabriela's
husband would loan her father money and neither one knew how much. In
fact, it appeared that Gabriela didn't know that she and Gemelo were
loaning money to the business. In our presence, Estanislao called Gemelo
on the phone and asked how much money he lent the business. Estanislao
said Gemelo told him that Gemelo lent the business $20,000. Once again, I
found it extremely perplexing that Gabriela (proposed liquor manager)
didn't know that her husband lent her father $20,000, and her father

(owner of the business) didn't know how much money Gemelo contributed.
It's also a little odd that Gemelo does not know how to spell his wife's
first name.
I asked Gabriela more about her husband and his responsibilities as the
manager of the La Cocina in York. She said he does a little bit of
everything. However, she added that Andrew Hager is the liquor manager
and takes care of everything involving alcoholic beverages. Investigator
Fiala and I were also told that "they" had spent $50,000 buying equipment
from the owner of San Pedro (prior business located in the building where
La Cocina will be located in G.I.).
Gabriela went on to say that Mary Badel, who is listed as the liquor
manager of the McCook La Cocina, lent a total of $40,000 to the York La
Cocina. Money from the York restaurant was used to pay for the equipment
in the Grand Island restaurant. Gabriela said that Mary Badel started the
La Cocina in McCook and eventually sold it to Estanislao. Investigator
Fiala located the York La Cocina application and confirmed that Mary
Badel was listed as someone who lent the business money. Investigator
Fiala also said that it was obvious by the handwriting that the person
who filled out the York application is the same person who filled out the
Grand Island application.
I spoke to a detective with the McCook Police Department and asked him
about the applicants. I was told that they don't have any documented
contacts with Estanislao Gutierrez or Maria de la luz Valdez. They have a
record of citing Gabriela for speeding, and they had contact with her and
Gemelo during a child abuse investigation in 2012. I also asked about
Mary Badel. The detective told me that Mary started the La Cocina in
McCook. He also said that they haven't had any documented contacts with
her since 2011. In fact, they showed Mary as living in Gering, Nebraska.
According to the Nebraska Liquor Control Commission (NLCC) web site, Mary
is currently listed as the liquor manager for the La Cocina in McCook. I
looked up Mary Badel in NCJIS and only found one. The address in NCJIS
matched the address that the McCook Police Department had. I tried to
call Mary using information obtained from the McCook PD. I was only able
to leave a voicemail and am not sure if the number I called actually
belongs to her. I have not received a return call. I seriously doubt that
Mary is a liquor manager for the McCook restaurant if she is still living
in Gering.
In addition to the information I got from the McCook PD, I received some
information from the Franklin Police Department in Franklin, Tennessee. A
records clerk advised that they had no documented contacts with Maria de
la luz Valdez or Gabriela Gutierrez. They had traffic contacts with
Estanislao and Gemelo. Estanislao was cited for not having proof of a
valid registration certificate and driving without headlights. I don't
know whether he was convicted of either offense. Gemelo was cited for an
improper turn and "squealing tires/excessive noise." Once again, I don't
know whether he was convicted of either charge. However, Franklin PD had
Gemelo's middle name listed as "Ismael" instead of Mario. I ran the
Tennessee driver's license number associated with the citation issued by
the Franklin PD. It comes back to Gemelo I. Leon Garcia. I ran the

Tennessee driver's license number provided by Gemelo Mario Leon Garcia,
and it comes back as Gemelo M. Leon Garcia. It appears the citations
issued by Franklin PD were issued to Ismael, not Mario. I didn't get a
chance to ask Gabriela if her husband and her brother-in-law have the
same first and last name but different middle names.
On 12/2/14, I received an e-mail from City Clerk RaNae Edwards which
included a faxed document from Gabriela documenting traffic convictions
in Nebraska for she and Gemelo. She still didn't include any convictions
from other states, but I don't know if Estanislao was convicted of the
charges in Franklin, Tennessee.
Also on 12/2/14, I called Mary Messman who works in the licensing
division at the NLCC. I explained the situation with Gemelo being an
illegal alien and lending money to the business, being on the business
account, signing the lease agreement as a witness, and filling out the
application. Mary said those actions would constitute hidden ownership
and make this a false application.
I would also argue that there are character and reputation issues with
Gemelo being an illegal alien and not having a license to drive, and not
reporting wages in Nebraska while managing a restaurant in York. Through
his wife's testimony, his driving record, and his lack of wages
associated with his Social Security number, he is flaunting his wanton
disregard of the law.
All in all, the Grand Island Police Department recommends that the
council not give local approval to this application due to the issues
with Gemelo. Gemelo is an illegal alien who can't get a liquor license.
However, all of the information stated in this report make Estanislao
Gutierrez's application look more like Gemelo Mario Leon Garcia's
application.

Background
At the January 4, 2011 Study Session the City Council was informed of an interest by
businesses along US Highway 281 near the Interstate 80 interchange about extending City
sanitary sewer to serve their property.
On January 11, 2011 City Council approved Mayor Vavricek to sign a “Letter of Intent” to
the Nebraska Department of Environmental Quality declaring the City’s willingness to
negotiate a public/private project with these businesses to extend City sanitary sewer south
along US Highway 281.
The May 17, 2011 Study Session provided an update to the City Council regarding several
meetings that were conducted between the City and the interested parties.
On September 27, 2011 City Council approved Sanitary Sewer District No. 528 in the
Wildwood Subdivision. This district provided support for the sanitary sewer extension
south along US Highway 281 to Interstate 80.
The City was granted $350,000 from a September 2011 settlement between JBS and
NDEQ, which must be applied to this sanitary sewer extension and will further support
such sanitary sewer extension.
The sanitary sewer extension south along US Highway 281 to Interstate 80 will help to
foster growth of the City towards the interstate and provide for future development.
Nebraska State Statutes stipulate that the acquisition of property requires a public hearing
and approval by the City Council. A public utility easement is needed in the SID 2
project are to accommodate public utilities. The easement will allow for construction,

operation, maintenance, extension, repair, replacement and removal of public utilities
within the easement.
This project is funded by the State Revolving Funds (SRF) Project # is C317867.
Discussion
One (1) permanent easement is needed from one (1) property owner in this project area.
All documents have been signed and returned by the property owner. Authorization of
the document is contingent upon City Council approval. Following is a summary of the

Background
There is an existing twenty foot wide easement that was used for power and telephone
across Lots One (1), Two (2), and Three (3) of Elder 3rd Subdivision. The building on
those lots was removed and the poles and lines serving that building were also removed.
The lots have subsequently been re-subdivided into Lot One (1) and Two (2), Elder 4th
Subdivision; therefore, the easement across those lots is no longer needed.
Discussion
The owner of the total property has requested the easement be vacated. Since no utilities
are using the easement and are not anticipated for future use, it is recommended that the
City Council vacate the easement as shown and described. This does not include the
shorter easement described by Document No. 201403491.

Background
The proposed district is part of the Utilities Department’s Master Plan and will extend a
new City water main along Engleman Road from Old Potash Highway, south for one-half
(1/2) mile.
The construction is the first phase to complete the westerly loop of the water system. The
project will provide for future development and fire protection for this portion of the
City. A subsequent phase will eventually extend the line to Stolley Park Road and
complete the loop of this section. Attached is a site map of the project’s location.
Discussion
Water Main District 467T will be constructed as a connection fee district. This is the
City’s standard method for installing large diameter “trunk” mains in section line roads
and provides for the City to be reimbursed for the related project costs when an adjacent
property receives municipal service. The associated fees are not collected until the user
connects to (taps) the main.

SECTION 3. Said improvement shall be made in accordance with plans and
specifications approved by the Engineer for the City, who shall estimate the cost thereof. Bids
for the construction of said water main shall be taken and contracts entered into in the manner
provided by law.
SECTION 4. The cost of construction of such water main connection district shall be
reported to the City Council, and the Council, sitting as a Board of Equalization, shall determine
benefits to abutting property by reason of such improvement pursuant to Section 16-6,103,
R.R.S. 1943. The special benefits shall not be levied as special assessments but shall be certified
by resolution of the City Council to the Hall County Register of Deeds. A connection fee in the
amount of the special benefit accruing to each property in the district shall be paid to the City of
Grand Island at such time as such property becomes connected to the water main in such district.
No property thus benefited by water main improvements shall be connected to the water main
until the connection fee is paid.
SECTION 5. This ordinance shall be in force and take effect from and after its passage,
approval, and publication, without the plat, within fifteen days in one issue of the Grand Island
Independent.
SECTION 6. This ordinance, with the plat, is hereby directed to be filed in the office of
the Register of Deeds of Hall County, Nebraska.
SECTION 7. After passage, approval and publication of this ordinance, notice of
the creation of said district shall be published in the Grand Island Independent, without the plat,
as provided by law.

Grand Island City Code Chapter 2-2 specifies that Regular Meetings of the City Council shall be held in
the Council Chambers of City Hall on the second and fourth Tuesdays of each month beginning at 7:00
p.m. Grand Island City Code Chapter 2-4 allows for Study Sessions to be held at the discretion of the City
Council. Typically these meetings are held on the first and third Tuesdays of the month when needed.
Special meetings may be called by the mayor or any four council members, upon twenty-four
hours written notice to every member of the council; provided, that the requirement of notice

Background
The electrostatic precipitator at the Platte Generating Station is the air quality control
equipment used to remove coal ash particulates from the plant’s boiler flue gas stream.
Proper performance of this equipment is required as part of the plant’s operating permit.
Due to volume and characteristics of the coal ash, the precipitator must be grit blasted
twice a year to remove ash build-up to allow the plant to remain below permitted
emission levels. In addition to maintaining performance, removal of the ash deposits also
allows an inspection of the precipitator internal surfaces and components.
Specifications were developed by the plant maintenance staff for the removal of ash
deposits throughout the precipitator and boiler including grit blasting of the electrostatic
precipitator, bulk vacuuming of the associated ductwork and hoppers; blasting deposits
from boiler tubing and high pressure water wash of the bottom ash system. The
specifications were issued for bids and the contract was awarded by Council to the low
responsive bidder, Meylan Enterprises of Omaha, Nebraska for $119,604.60 on August
12, 2014.
Discussion
Meylan completed the contract requirements at the front-end of the fall shutdown. When
servicing the boiler was complete, additional ash deposits required water blasting and
vacuum services which were not part of the contract. Meylan Enterprises, Inc., proposed
to perform these items at an additional cost of $9,931.74, for a final contract cost of
$129,536.34. This cost was based on unit pricing for services included in the original bid
documents in the event of the addition or deletion of work scope by the contractor.

Background
Public Works Staff in conjunction with the design engineer, Black & Veatch of Kansas
City, Missouri have developed multi-year replacement plan for the City of Grand Island’s
large diameter gravity sanitary sewer interceptor network. The current planned interceptor,
entitled the “North Interceptor” will replace aged force main sanitary sewer, reduce or
eliminate current sewer pumping station(s), and provide additional capacity for existing
and new growth areas of Grand Island.
The new North Interceptor route was developed to incorporate, and partner with other
utilities for the Capital Avenue Widening Project, and the new Headworks Pumping Station
Project at the Wastewater Treatment Plant. This project is funded by SRF Project No.
C317867-01, however easements, legal fees & administrative costs are not reimbursable by
these funds.
A phased approach of constructing the North Interceptor is as follows:
Phase I - Wastewater Treatment Plant (WWTP) to 7th Street / Skypark Road
Phase II (Part A) - 7th Street / Skypark Road to Broadwell Avenue
Phase II (Part B) - Broadwell Avenue to Webb Road
Phase II (Part C) - Webb Road to Diers Avenue (Lift Station No. 19)
A Temporary Construction easement from Gary & Estel Ummel and Timothy & Lisa
Spiehs is necessary for Phase II, Part A of this project to be completed, which must be
approved by City Council. A sketch is attached to show the temporary construction
easement areas.

Temporary construction easements, in the amount of $2,290.00, is needed from two (2)
property owners for Phase II, Part A to be constructed.
All documents have been signed and returned by the property owners. Authorization of
the documents and payment to the property owners of $2,290.00 is contingent upon City
Council approval.

Background
The GRACE Foundation was established in 2008 to assist local cancer patients, survivors
and their families.
The 4th Annual Race for GRACE event was held in April 2014, with the foundation
raising just over $31,000 to assist individuals and their families affected by cancer right
here in our local community. There were over 2,000 runners last year, which was an
increase of 500 participants from the previous year.
Discussion
The GRACE Foundation is seeking Council approval and notice to the Nebraska
Department of Roads for their 5th annual Race for GRACE in downtown Grand Island on
April 11, 2015.
The race route will require the use of City streets, as well as 2nd Street (Lincoln
Highway). Please see the attached map of the route.
State Statute 39-1359 requires the City Council to approve the route and for the City to
then inform the Nebraska Department of Roads that the route has approval if it closes or
blocks any part of a State highway. This is a requirement for any race, parade or march
that would create some closure of the highway. This action then makes the City
responsible for the liability of using a State highway for the event.
In planning for the event and to achieve the best identified route the request has been
reviewed by public safety and public works.

WHEREAS, the GRACE Foundation is seeking Council approval and notice to
the Nebraska Department of Roads for their 5th Annual Race for GRACE in downtown Grand
Island on April 11, 2015; and
WHEREAS, the GRACE Foundation has worked with the City in planning &
developing an acceptable race route; and
WHEREAS, Nebraska State Statute 39-1359 requires cities to obtain Council
approval and proper notification of the Nebraska Department of Roads when any event is going
to require the closure or partial closure of a State highway; and
WHEREAS, the race route involves a stretch of 2nd Street (Lincoln Highway)
from Cleburn Street to Oak Street.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL
OF THE CITY OF GRAND ISLAND, NEBRASKA, that the use of City streets and State
highway to accommodate the 5th Annual Race for GRACE on April 11, 2015 is hereby approved.

Background
George Park is one of Grand Island’s largest city parks which feature four ball fields,
picnic areas, playgrounds, and more. The ball fields are highly used by recreational and
competitive teams for softball and baseball games, practices, and tournaments.
Currently there is no sidewalks connecting the fields, parking areas, and restroom
facilities. The two east field backstop, dugout, and dirt path areas connecting the east
parking area have drainage problems.

Discussion
The Parks and Recreation Department is recommending adding an eight foot wide
sidewalk/trail connecting the east and west ends of the park, installing a drainage pipe on
the east end of the park, and fixing existing low areas. The new concrete path will
improve drainage and accessibility for park patrons to access the ball fields, restrooms,
and parking areas.
Two bids were received for the construction of a new sidewalk/trail in George Park.
Diamond Engineering of Grand Island, NE $86,444.35
B-D Construction of Columbus, NE $154,160.00
Staff recommends Diamond Engineering of Grand Island to construct the new
sidewalk/trail in George Park. The project will be funded by the Parks Misc. Capital
Account 40044450-90027 and the Parks Trail Fund 40044450-90031.

Background
The Police Department budgeted $281,500 for the purchase of eleven fleet vehicles for
the 2015 fiscal year. We have received the State bids for vehicles. We are requesting to
purchase the following vehicles for the Police Department fleet:
3 – Ford TPI all-wheel drive sedans. State contract price $ 25,330.00 each plus
$1,222.00 in options. Final cost $26,552.00 each Sid Dillon Ford, Ceresco, NE.
3 – Ford 4 wheel drive Expeditions. State contract price $31,655.00 each less
$401.00 in deducts. Final cost $31,254.00 each Anderson Ford Group, Lincoln.
2 – Ford PUV all-wheel drive SUVs. State contract price $$27,770 each less
$550.00 in deducts. Final cost $27,220.00 each Anderson Ford Group,
Lincoln.
2 – Ford Fusion sedans. State contract price $17,417 each plus $100.00 shipping.
Final cost $17,517.00 each Anderson Ford Group, Lincoln.
1 – 2012 Dodge Ram pickup truck. Quoted price $17,689.00. Roy’s Grand
Dodge, Grand Island.
The total cost of the eleven vehicles is $280,581.00 which is within the Department
budget of $281,500.
Discussion
The Police Department budgeted $281,500 for the purchase of eleven fleet vehicles for
the 2015 fiscal year. An explanation of the vehicles is as follows:

3 – 2015 Ford TPI all-wheel drive sedans – replacement vehicles for high mileage patrol
fleet vehicles. State contract #14148. Price - $25,330.00 each. Additional and deducted
options plus shipping is $1222.00 per car. Cost per car is $26,552.00. Total cost for three
sedans is $79,656.00.
The State contract for the Ford TPI sedan which is the primary vehicle of the Patrol fleet
was awarded to Sid Dillon Ford of Ceresco, NE. The cost for the TPI sedans increased
significantly between 2014 and 2015. All-wheel drive has been standard on these
vehicles in past years and is now an option which made the price per vehicle more than
we had budgeted. The Department has found the all-wheel drive option to be valuable
and we recommend we continue to purchase all-wheel drive vehicles. We contacted
Anderson Ford of Grand Island and Lincoln and their price for the same vehicle would be
between $1000 and $2000 over the State bid price.
3 –2015 Ford 4 wheel drive Expeditions – replacement vehicles for high mileage
Expeditions currently in the fleet. State contract #14153. Price $31,655.00 each.
Additional costs and deducted options plus shipping is $401.00 less. Cost per car is
$31,254.00. Total cost for three Expeditions is $93,762.00.
The State contract for Ford Expeditions was awarded to Anderson Ford. The Expeditions
are primarily driven by Patrol Sergeants and are available for service during heavy snow
storms when the regular patrol fleet vehicles are incapable of operation. The Expeditions
are driven by Patrol Sergeants and allow them to carry extra equipment and to limit
mileage. The Expeditions are lower priced than any comparably equipped 4 wheel drive
pickup truck or SUV and have proven reliable in the fleet.
2 – 2015 Ford PUV all-wheel drive SUVs. One vehicle replaces a high mileage Patrol
fleet vehicle and one replaces a Patrol fleet vehicle that was totaled in a traffic crash.
State contract #14128. Price each $27,770.00. Additional and deducted options plus
shipping is $550.00 less. Cost per PUV is $27,220.00. Total cost for two PUV vehicles is
$54,440.00.
The Ford PUV state contract was awarded to Anderson Ford. The Ford PUV all-wheel
drive SUV is built on the same frame as the TPI sedan. The SUVs provide more interior
room and front seat leg room. The Department budgeted for two of the SUVs in the
Patrol fleet this year to determine their suitability for use in the fleet.
2 – 2015 Ford Fusion sedans – Replacing one older sedan in Investigations and one older
sedan in Administration. State contract #14117. Price each $17,517.00 which includes a
shipping cost of $100.00. Total cost for two Ford Fusions $35,034.00.
The State contract for the Ford Fusion was awarded to Anderson Ford. The Fusion sedans
replace Investigations and Administration fleet vehicles that are over ten years old.

1 - 2012 Dodge Ram pickup truck – Replacing one older high mileage pickup truck in the
Code Enforcement fleet. Total cost $ 17,689.00. Roy’s Grand Dodge, Grand Island.
The Department Code Enforcement fleet has three pickup trucks. The trucks allow the
Code Enforcement Officers to transport large items of property and also tow the
Department speed trailer to and from locations. The State contract for a new truck was
significantly over the Department’s budgeted amount. The Department sought quotes
from Roy’s Grand Dodge, Anderson Ford and Dinsdale Chevrolet/GMC and also used
the State contract award for a new or used low mileage pickup truck for under $20,000.
Dinsdale Chevrolet/GMC did not provide a quote. Anderson Ford submitted the State
contract price for a new Ford pickup which was over $20,000 with the requested options.
Roy’s Grand Dodge provided a quote of $ 17,689.00 for a 2012 Dodge Ram pickup truck
with under 45,000 miles and the remainder of warranty. The 2012 Dodge pickup truck
will fulfill the needs in the Code Enforcement fleet.
In summary, the Police Department is recommending the City purchase:

According to Article III – Appointed and Hired Officials, Section 2-30 Officers;
Appointive of the Grand Island City Code and Neb. Rev. Stat., §16-308, (see attached)
the Mayor is required to appoint statutory officers for his term. Statutory officers include:
1).City Administrator
2).City Attorney
3)City Clerk
4)City Engineer/Public Works Director
5)City Treasurer/Finance Director
These officers also must be approved by the City Council.
Discussion
According to Grand Island City Code Section 2-30, I am requesting approval of the
following statutory officers:

Division 1. General
§2-30. Officers; Appointive
The following shall constitute the statutory officers of the City of Grand Island which
shall be appointed by the mayor and approved by the council. These officers shall hold office until
the end of the mayor's term and until their successors are appointed and qualified. These
appointive officers may be removed at any time by the mayor, with the approval of a majority of
the council:

City Attorney
City Clerk
City Engineer / Public Works Director
City Treasurer / Finance Director

Each city of the first class shall have such departments and appointed officers as shall be
established by ordinance passed by the city council, which shall include a city clerk, treasurer,
engineer and attorney, and such officers as may otherwise be required by law. Except as
provided in Chapter 19, article 6, the mayor may, with the approval of the city council, appoint
the necessary officers, as well as an administrator, who shall perform such duties as prescribed
by ordinance. Except as provided in Chapter 19, article 6, the appointed officers may be removed
at any time by the mayor with approval of a majority of the council. The office of administrator
may not be held by the mayor. The appointed administrator may concurrently hold any other
appointive office provided for in this section and section 16-325.

R E S O L U T I O N 2014-372
WHEREAS, under Neb. Rev. Stat., §16-308, the office of City Engineer for the
City of Grand Island, Nebraska, is an appointed position; and
WHEREAS, under Grand Island City Code, §2-30, the office of City Engineer
and Public Works Director have been consolidated into one position for the City of Grand Island,
Nebraska, and is an appointed position; and
WHEREAS, the Mayor, with the approval of the City Council, may appoint the
position of City Engineer/Public Works Director; and
WHEREAS, the Mayor has recommended the appointment of John Collins P.E.
as the City Engineer/Public Works Director effective December 9, 2014; and
WHEREAS, this position appointed by the Mayor and confirmed by the City
Council shall hold the position to which they may be appointed until the end of the Mayor’s term
of office; and
WHEREAS, this position appointed by the Mayor may be removed at any time by
the Mayor with approval of a majority of the City Council.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL
OF THE CITY OF GRAND ISLAND, NEBRASKA, that John Collins P.E. is hereby duly
appointed the City Engineer/Public Works Director for the City of Grand Island, Nebraska, until
the end of the Mayor’s term of office.

Background
According to Article III – Appointed and Hired Officials, Section 2-30 Officers;
Appointive of the Grand Island City Code and Neb. Rev. Stat., §16-308, the Mayor is
required to appoint statutory officers for his term. Statutory officers include:
1).City Administrator
2).City Attorney
3)City Clerk
4)City Engineer/Public Works Director
5)City Treasurer/Finance Director
These officers also must be approved by the City Council.
Discussion
According to Grand Island City Code Section 2-30, I am requesting approval of William
Clingman as the Interim Treasurer/Finance Director. Mr. Clingman presently serves as
the Senior Accountant in the Finance Department. Mr. Clingman earned a Bachelor’s
Degree in Business Administration from Creighton University and a Masters of Business
Administration Degree from Bellevue University. Prior to his employment with the City
of Grand Island Mr. Clingman held accounting positions for ConAgra Foods and the
Kiewit Corporation.
Alternatives
It appears that the Council has the following alternatives concerning the issue at hand.
The Council may:

1.Approve the appointment of Mr. Clingman
2.Deny the appointment of Mr. Clingman
3.Ask the Mayor to reconsider his recommendation for the appointment of an
Interim Treasurer/Finance Director
Recommendation
City Council is recommended to approve the appointment of Mr. Clingman.

R E S O L U T I O N 2014-373
WHEREAS, under Neb. Rev. Stat., §16-308, the office of Treasurer/Finance
Director for the City of Grand Island, Nebraska, is an appointed position; and
WHEREAS, under Grand Island City Code, §2-30, the office of
Treasurer/Finance Director for the City of Grand Island, Nebraska shall be appointed by the
mayor and approved by the council; and
WHEREAS, the position will become vacant on December 9, 2014 and an interim
appointment may be made; and
WHEREAS, the Mayor has recommended the appointment of William Clingman
as Interim City Treasurer/Finance Director effective December 9, 2014 until such time as another
appointment is made; and
WHEREAS, Mr. Clingman will be compensated at step one of the current
Finance Director pay scale during the interim in compliance with the City Personnel Rules.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL
OF THE CITY OF GRAND ISLAND, NEBRASKA, that William Clingman is hereby duly
appointed Interim Treasurer/Finance Director for the City of Grand Island, Nebraska.
