03/26/2024 Resolutions 2024-70 ORDINANCE NO. 9970 An ordinance rezoning certain tracts of land within the zoning jurisdiction of the City of Grand Island; changing the land use classification of a tract of land comprising part of the East %2 of the Southwest Quarter and the West half of the Southeast Quarter (E%2 of the SW1/4, and Wl/2 of the SEA ) of Section Twenty-Five (25), Township Eleven (11) North, Range Ten (10) West of the 6th P.M., in Hall County,Nebraska. Located north of Husker Highway and west of Prairieview Street in Grand Island, Nebraska. from R2 Low Density Residential Zone to RD Residential Development Zone in Grand Island, Hall County, Nebraska as more particularly described below, and directing that such zoning change and classification be shown on the Official Zoning Map of the City of Grand Island; amending the provisions of Section 36-44; and providing for publication and an effective date of this ordinance. WHEREAS, the Regional Planning Commission on March 13, 2024, held a public hearing and made a recommendation on the proposed zoning of such area; and WHEREAS, notice as required by Section 19-923, R.R.S. 1943, has been given to the Board of Education of School District No. 2 in Hall County,Nebraska; and WHEREAS, after public hearing on March 26, 2024, the City Council found and determined the change in zoning be approved and made. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA: SECTION 1. The following tracts of land is hereby rezoned and reclassified and changed from R2 Low Density Residential Zone to amended RD Residential Development Zone: RD RESIDENTIAL DEVELOPMENT ZONE A TRACT OF LAND LOCATED IN PART OF THE WEST HALF OF THE SOUTHEAST QUARTER (W1/2, SE1/4) OF SECTION TWENTY-FIVE (25), TOWNSHIP ELEVEN (11) ORDINANCE NO. 9970 (Cont.) NORTH, RANGE TEN (10) WEST OF THE 6TH P.M., IN THE CITY OF GRAND ISLAND, HALL COUNTY, NEBRASKA, AND MORE PARTICULARLY DESCRIBED AS FOLLOWS: COMMENCING AT THE NORTHEAST CORNER OF LEGACY 34 THIRD SUBDIVISION AND ALSO BEING THE NORTHEAST CORNER OF OUTLOT J, LEGACY 34 THIRD SUBDIVISION SAID POINT BEING THE POINT OF BEGINNING; THENCE ON AN ASSUMED BEARING OF S89°32'23"W, ALONG THE NORTH LINE OF SAID LEGACY 34 THIRD SUBDIVISION AND THE NORTH LINE OF LEGACY 34 SECOND SUBDIVISION, A DISTANCE OF 284.12 FEET TO A POINT OF CURVATURE; THENCE ON THE NORTH LINE OF OUTLOT C, LEGACY 34 SECOND SUBDIVISION AND BRECKEN STREET AND ALSO AROUND A CURVE IN A COUNTER CLOCKWISE DIRECTION, HAVING A DELTA ANGLE OF 41°49'49", HAVING A RADIUS OF 285.00 FEET, AND CHORD BEARING S68°36'35"W A CHORD DISTANCE OF 203.48 FEET TO A CONTINUED POINT OF CURVATURE; THENCE ON SAID NORTH LINE OF OUTLOT C AND BRECKEN STREET AND ALSO AROUND A CURVE IN A CLOCKWISE DIRECTION, HAVING A DELTA ANGLE OF 89°25'48", HAVING A RADIUS OF 70.00 FEET, AND CHORD BEARING N87°35'26"W A CHORD DISTANCE OF 98.50 FEET; THENCE N45°34'52"E, ON A NORTHEASTERLY LINE SAID OUTLOT C, AND OUTLOT B, LEGACY 34 SECOND SUBDIVISION, A DISTANCE OF 249.70 FEET TO A NORTHERLY CORNER OF OUTLOT B, LEGACY 34 SECOND SUBDIVISION AND WEAVER STREET; THENCE N45°34'52"E A DISTANCE OF 575.94 FEET TO A POINT OF CURVATURE; THENCE AROUND A CURVE IN A CLOCKWISE DIRECTION, HAVING A DELTA ANGLE OF 24°39'21", HAVING A RADIUS OF 130.00 FEET, AND CHORD BEARING N57°54'32"E A CHORD DISTANCE OF 55.51 FEET; THENCE N69°22'45"E A DISTANCE OF 62.00 FEET; THENCE N65°58'33"E A DISTANCE OF 59.14 FEET; THENCE N77°54'14"E A DISTANCE OF 170.05 FEET TO A POINT ON THE EAST LINE OF THE WEST HALF OF THE SOUTHEAST QUARTER (W1/2, SE1/4); THENCE S00°28'30"E, ON SAID EAST LINE OF THE W1/2, SE1/4, A DISTANCE OF 624.79 FEET TO THE POINT OF BEGINNING. SAID TRACT CONTAINS A CALCULATED AREA OF 329925.41 SQUARE FEET OR 7.574 ACRES MORE OR LESS OF WHICH 0.805 ACRES ARE NEW DEDICATED ROAD RIGHT OF WAY. SECTION 2. That the proposed development plan for the above described real estate, as shown on the plan submitted with the rezoning request is approved finding that such approval conform to the Grand Island Comprehensive Plan and that such development will enhance the City and provide for the health, safety and welfare of the citizens of Grand Island by providing additional housing opportunities. - 2 - ORDINANCE NO. 9970 (Cont.) SECTION 3. That the Official Zoning Map of the City of Grand Island, Nebraska, as established by Section 36-44 of the Grand Island City Code be, and the same is, hereby ordered to be changed, amended, and completed in accordance with this ordinance and that the approved development plan be kept in the records of the Hall County Regional Planning Department. SECTION 4. That this ordinance shall be in force and take effect from and after its passage and publication, within fifteen days in one issue of the Grand Island Independent as provided by law.
