WHEREAS, a public utility easement is required by the City of Grand Island from
Hornady Family Limited Partnership to survey, construct, inspect, maintain, repair, replace, relocate,
extend, remove, and operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS, a public hearing was held on March 12, 2024, for the purpose of
discussing the proposed acquisition of a twenty (20.0) foot wide utility easement in part of the
Northwest Quarter of the Northeast Quarter (NW 1/4,NE1/4) of Section Twenty Four (24), Township
Eleven (11) North, Range Ten (10) West of the 6th PM, Hall County, Nebraska, the boundary of the
utility easement and right-of-way tract being more particularly described as follows:
Commencing at the Northwest corner of the Northwest Quarter of the Northeast Quarter
(NW1/4, NE1/4) of Section Twenty Four (24), Township Eleven (11) North, Range Ten (10)
West of the 6�'' PM, Hall County, Nebraska; thence southerly along the westerly line of the
said Northwest Quarter of the Northeast Quarter (N W 1/4, NE 1/4) of said Section Twenty
Four (24), a distance of five hundred fifty-four and seven tenths (554.7) feet; thence
deflecting left 117°20'30" and running in a northeasterly direction, a distance of thirty-seven
and fifteen hundredths (37.15) feet to a point on the easterly right-of-way line of Claude
Road, said point also being the Actual Point of Beginning; thence continuing northeasterly, a
distance of one hundred thirty-three and sixty-four hundredths (133.64) feet; thence
deflecting right 27°43'32" and running in an easterly direction, a distance of forty (40.0) feet
to the point of termination. The side lines of the above described tract shall be prolonged or
shortened as required to terminate on the boundary of Grantor's property.
The above-described easement and right-of-way containing a total of .08 acres, more or
less as shown on the plat dated 2/14/2024, marked Exhibit "A", attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Hornady Family Limited Partnership, on and
over the tract of land described herein and as depicted on Exhibit A hereto.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
