CALL TO ORDER Pursuant to due call and notice thereof, a Regular Meeting of the City Council of the City of Grand Island, Nebraska was conducted in the Council Chambers of City Hall, 100 East First Street, on November 21, 2023. Notice of the meeting was given in The Grand Island Independent on November 15, 2023. Mayor Roger G. Steele called the meeting to order at 7:00 PM. The following City Council members were present: Maggie Mendoza, Bethany Guzinski, Jack Sheard, Mike Paulick, Mark Stelk, Mitch Nickerson and Jason Conley. Councilmembers Michelle Fitzke, Doug Lanfear and Chuck Haase were absent. The following City Officials were present: City Administrator Laura McAloon, Deputy City Clerk Jill Granere, Assistant City Administrator/Finance Director Patrick Brown, City Attorney Kari Fisk and Public Works Director Keith Kurz. 2. Approving Payment of Claims for the Period of November 8, 2023 through November 21, 2023 for a total amount of $9,116,447.47. c. #2023-296 - Approving Termination of Interlocal Agreement with Hall County for Public Transportation. d. #2023-297 - Approving Bid Award for Custer Avenue- State Street to Capital Avenue Roadway Rehabilitation; Project No. 2022-P-6 (Phase IV) with CL Construction of Wahoo, Nebraska in an amount of $1,289,532.80. e. #2023-298 - Approving Purchase of Trojan Technologies Items for UV System at the Wastewater Treatment Plant in an amount of $44,242.50. f. #2023-299 - Approving Temporary Lease for Dedicated Parking Stalls in the Public Parking Lot at South Locust Street and 1 st Street- RW Sorensen Construction. g. #2023-300 - Approving Amendment No. 5 to Engineering Consulting Agreement for Custer Avenue- Old Potash Highway to Capital Avenue Roadway Rehabilitation with Olsson, Inc. of Grand Island, Nebraska for an increase amount not to exceed $77,000.00 for a revised amount of $497,430.00. h. #2023-301 - Approving Change Order No. 1 18th Street- Moores Creek Drainway to Diers Avenue; Project No. 2022-P-8 with The Diamond Engineering Company of Grand Island, Nebraska for a final completion date of June 15, 2024. i. #2023-302 - Approving Bid Award for Lead Service Line Replacement Supplies with Municipal Supply, Inc. of Hastings, Nebraska in an amount of $77,274.33. 9. PUBLIC HEARINGS a. Public Hearing on Request from Mi Pueblo Mexican Restaurant, LLC dba Mi Pueblo Mexican Restaurant, 2610 South Locust Street, for a Class "I" Liquor License. Deputy City Clerk Jill Granere reported an application for a Class "I" Liquor License had been received from Mi Pueblo Mexican Restaurant, LLC dba Pueblo Mexican Restaurant, 2610 South Locust Street. Ms. Granere presented the following exhibits for the record: application submitted to the Liquor Control Commission and received by the City on October 23, 2023; notice to the general public of date, time, and place of hearing was published on November 10, 2023; notice to the applicant of date, time, and place of hearing was mailed on October 23, 2023. Also submitted was a Liquor Manager Designation for Carlos Munoz, 8211 Broken Ridge Drive, Lincoln, Nebraska. Staff recommended approval contingent upon final inspections and Liquor Manager designation for Carlos Munoz. No public testimony was heard. #2023-303 - Approving Request from Mi Pueblo Mexican Restaurant, LLC dba Mi Pueblo Mexican Restaurant, 2610 South Locust Street, for a Class "I" Liquor License and Liquor Manager Designation for Carlos Munoz, 8211 Broken Ridge Drive, Lincoln, Nebraska. 2 City Council Regular Meeting, November 21, 2023 Motion by Guzinski, second by Sheard to approve Resolution #2023-303. Upon roll call vote, all voted aye. Motion adopted. b. Public Hearing on Redevelopment Plan CRA Area 28 for an Amendment to the Area Included in the Enhanced Employment Area to Include Additional Properties, specifically: Balz, Wells Fargo, Red Lobster in Grand Island. (Woodsonia Hwy 281, LLC). Community Development Director Chad Nabity reported Woodsonia Hwy 281, LLC had requested that the CRA and Council consider enlarging the Enhanced Employment Area approved in Conestoga Marketplace Redevelopment Plan. The proposal would add 3 parcels to the existing EEA including Red Lobster, Wells Fargo, and Balz. CRA reviewed the proposed development on October 18, 2023 and forwarded it to the Hall County Regional Planning Commission on November 1, 2023. Staff recommend approval. No further testimony was heard. #2023-304 - Approving Redevelopment Plan CRA Area 28 for an Amendment to the Area Included in the Enhanced Employment Area to Include Additional Properties, specifically: Balz, Wells Fargo, Red Lobster in Grand Island. (Woodsonia Hwy 281, LLC). Motion by Paulick, second by Conley to approve Resolution #2023-304. Upon roll call vote, all voted aye. Motion adopted. c. Public Hearing on Redevelopment Plan CRA Area 37- 610 N Darr Avenue in the City of Grand Island, Nebraska. (Beckett Inc.). Community Development Director Chad Nabity reported Beckett Inc. was proposing to redevelop the former Parkview Nursing Home at 610 N. Darr Avenue. They were proposing to rehabilitate the facility for people who have completed their initial treatment for drug and alcohol addiction but are not ready to move into independent living. CRA reviewed the proposed development on October 18, 2023 and forwarded it to the Hall County Regional Planning Commission on November 1, 2023. Staff recommend approval. #2023-305 - Approving Redevelopment Plan CRA Area 37- 610 N Darr Avenue in the City of Grand Island, Nebraska. (Beckett Inc.) The following people spoke in support: • Phillip Beckett II • Chase Francl Motion by Nickerson, second by Guzinski to approve Resolution #2023-305. Upon roll call vote, all voted aye. Motion adopted. d. Public Hearing on Redevelopment Plan CRA Area 17- Multiple Projects in the Prairie Commons Fourth and Sixth Subdivisions and Ponderosa Village Second Subdivision located south of Schimmer Drive and west of U.S. Highway 281 in the City of Grand Island, Nebraska. (Prataria Ventures LLC). 3 City Council Regular Meeting, November 21, 2023 Community Development Director Chad Nabity reported Prataria Ventures, LLC was proposing additional development south of the Central Nebraska Regional Hospital. They were proposing five projects including: a new corporate office for Chief Industries, a hotel, a bar/restaurant, a quick serve restaurant and a financial services/office building. CRA reviewed the proposed development on October 18, 2023 and forwarded it to the Hall County Regional Planning Commission on November 1, 2023. Staff recommend approval. David Ostdiek spoke in support. #2023-306 - Approving Redevelopment Plan CRA Area 17- Multiple Projects in the Prairie Commons Fourth and Sixth Subdivisions and Ponderosa Village Second Subdivision located south of Schimmer Drive and west of U.S. Highway 281 in the City of Grand Island, Nebraska. (Prataria Ventures LLC). Motion by Sheard, second by Stelk to approve Resolution #2023-306. Upon roll call vote, all voted aye. Motion adopted. e. Public Hearing on Zoning Change for property located south of Lake Street and west of Locust Street in Grand Island, Nebraska. (Brian Levander). Community Development Director Chad Nabity reported Brian Levander had the option to purchase property on South Locust south of Lake Street and was requesting that the zoning on the property be changed from LLR Large Lot Residential in a GCO Gateway Corridor Zone to B2 General Business Zone in a Gateway Corridor Zone. He proposed building a new auto repair and body shop at the location. Staff recommend approval. No further testimony was heard. #9956 - Consideration of Approving Zoning Change for property located south of Lake Street and west of Locust Street in Grand Island, Nebraska. (Brian Levander) (First Reading) Motion by Nickerson, second by Paulick to approve Ordinance #6656 on its first reading. Upon roll call vote, all voted aye. Motion adopted. f. Public Hearing on Workforce Housing Incentive Plan to Consider Approving a Plan that would allow the use of Tax Increment Financing (TIF) to Construct Workforce Housing as Permitted and Defined in the Nebraska Community Development Law. Community Development Director Chad Nabity reported there was a severe housing shortage impacting all communities within the State of Nebraska. In an attempt to address the issue, the State of Nebraska had authorized the use of T� Increment Financing (TIF) by communities to address the issue. The concept of using TIF was to help produce Workforce Housing presented to the Council on October 17, 2023. Staff recommend approval. Motion by Stelk, second by Nickerson to approve Resolution #2023-307. Upon roll call vote, all voted aye. Motion adopted. 10. REQUEST AND REFERRALS 11. RESOLUTIONS a. #2023-308 - Approving a Resolution Allowing Expedited Reviews of Redevelopment Plans Meeting the Requirements of the Nebraska Community Development Law. Community Development Director Chad Nabity reported the Nebraska Unicameral approved the use of expedited reviews of redevelopment plans (MicroTIF) during the passage of LB 1020 and had since modified it with the passage of the LB1065 in 2022 and LB531 in 2023. The goal was to make Tax Increment Financing more accessible to individuals that own properties in the oldest parts of rural Nebraska communities. The attached resolution would limit the number of MicroTIF applications to 20 annually. Estimated cost of the process and tracking of the applications would cost the city between $600 and potentially more than $800 over the 15 year period for each application. Applications would be reviewed by the City Administrator and allow them to designate another staff to conduct the review. Staff recommend approval. Motion by Guzinski, second by Sheard to approve Resolution #2023-308. Upon roll call vote, all voted aye. Motion adopted. 12. ORDINANCES a. #9957 - Consideration of Approving Salary Ordinance. Human Resource Director Aaron Schmid reported there was a huge gap in both compensation and oversight requirements in regard to the responsibilities of an Assistant Utilities Direcotr compared to an Engineer I/II/Sr. Adding a Utilities Manager position allowed a mid-point between those two designations. Staff recommended approval. Motion by Paulick, second by Guzinski to approve Ordinance #9957 on First Reading. Upon roll call vote, all voted aye. Motion adopted. b. #9958 - Consideration of Amending Chapter 8 of the Grand Island City Code to Adopt the 2021 International Building Code, 2021 International Residential Code and 2021 International Existing Building Code. 5 City Council Regular Meeting, November 21, 2023 Chief Building Operator Ed Klimek reported the City of Grand Island had adopted and enforced building codes, which regulate the construction of buildings within the City and jurisdictional areas. The Building Code Advisory Board had recently reviewed the 2021 editions of the codes and recommends adopting the revisions. Motion by Nickerson, second by Guzinski to approve Ordinance #9958 on First Reading. Upon roll call vote, all voted aye. Motion adopted. c. #9959 - Consideration of Amending Chapter 16 of the Grand Island City Code to Adopt the 2021 International Fire Code. Fire Division Chief Fred Hotz reported the City of Grand Island had adopted and enforced building codes, which regulate the construction of buildings within the City and jurisdictional areas. The City currently adopts and enforced the 2018 edition of the International Fire Code (IFC) as published by International Code Council and the Building Division was requesting to adopt the more current version, so the Administration is requesting that the City also adopted the 2021 edition of the International Fire Code. Staff recommended approval. Motion by Paulick, second by Conley to approve Ordinance #9959 on First Reading. Upon roll call vote, all voted aye. Motion adopted.
