WHEREAS, a public utility easement is required by the City of Grand Island from
Northwest Crossings, LLC, to survey, construct, inspect, maintain, repair, replace, relocate, extend,
remove, and operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS, a public hearing was held on June 27, 2023, for the purpose of
discussing the proposed acquisition of a permanent and perpetual easement and right-of-way tract
located through in part of the Southeast Quarter of the Southeast Quarter (SE1/4, SE1/4), of Section
One (1), Township Eleven (11) North, Range Ten (10) West of the 6th PM, in the City of Grand
Island, Hall County, Nebraska; the boundary of the twenty (20.0) foot wide utility easement and
right-of-way tract being more particularly described as follows:
Commencing at the Southeast corner of the Southeast Quarter of the Southeast
Quarter (SE 1/4, SE 1/4), of Section One (1), Township Eleven (11) North, Range Ten
(10) West of the 6th PM, in the City of Grand Island, Hall County, Nebraska; thence
westerly along the southerly line of the Southeast Quarter of the Southeast Quarter
(SE1/4 SEl/4), of said Section One (1), on an assumed bearing ofN89°53'32"W, a
distance of two hundred sixty-four and forty-seven hundredths (264.47) feet; thence
NO°25' 00"W, a distance of forty and forty-one hundredths (40.41) feet to a point on
the northerly right-of-way line of Capital Avenue, said point also being the ACTUAL
Point of Beginning; thence continuing NO°25' 00"W along the westerly line of a tract
of land described in Instrument #201503640, recorded in the Hall County, Nebraska
Register of Deeds Office, a distance of one hundred fifty-one (151.0) feet; thence
N89°35'00"E, a distance of twenty (20.0) feet; thence SO°25'00"E a distance of one
hundred fifty-two and twenty-four hundredths (152.24) feet to a point on the
northerly right-of-line of said Capital Avenue; thence N86°52'47"W along the
northerly right-of-way line of said Capital Avenue, a distance of twenty and four
hundredths (20.04) feet to the said Point of Beginning.
The above-described easement and right-of-way containing a total of .07 acres, more or
less, as shown on the plat dated 5/31/2023, marked Exhibit "A", attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Northwest Crossings, LLC, on and over the tract
of land described herein and as depicted on Exhibit A hereto.
BE IT FURTHER RESOLVED that the Mayor and designee are hereby authorized to
execute all documents necessary to effect the purpose of this Resolution.
