11/22/2022 Resolutions 2022-334R E S O L U T I O N 2022-334 WHEREAS, a public utility easement is required by the City of Grand Island from Gary and Dee Rowe, to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including power lines; and WHEREAS, a public hearing was held on November 22, 2022, for the purpose of discussing the proposed acquisition of a permanent and pf,rpetual easement and right-of-way tract located through a part of the Northeast Quarter of the Nortrieast Quarter (NE1/4, NE1/4), of Section Twenty-Seven (27), Township Eleven (11) North, Range T'en (10) West ofthe 6�' PM, Hall County, Nebraska; the thirty (30.0) foot wide utility easement and riight-of-way tract being more particularly described as follows: Beginning at the Northwest corner of Rowe Sec;ond Subdivision, Hall County, Nebraska; thence northerly, along the westerly line of a tract of land described in Inst. #92107608, recorded in the Hall County, Nebra:;ka Register of Deeds Office, a distance of nine hundred fifty-five (955.0) feet; thence easterly and parallel with the northerly line of said Rowe Second Subdivision, a distance of thirty (30.0) feet; thence southerly and parallel with the westerly line of said tract of land described in Inst. #92107608, a distance of nine hundred fifty-five (955.0) feet to a point on the northerly line of said Rowe Second Subdivision; th�ence westerly along the northerly line of said Rowe Second Subdivision, a distance; of thirty (30.0) feet to the said Point of Beginning. The above-described easement and right-of-way containing a total of .46 acres, more or less, as shown on the plat dated 8/24/2022, markeci Exhibit "A", attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Gary and Dee Rowe, on and over the tract of land described herein and as depicted on Exhibit A hereto.
