WHEREAS, a public utility easement is required by the City of Grand Island from
Mountain Tower & Land, LLC, to survey, construct, inspect, maintain, repair, replace, relocate,
extend, remove, and operate thereon, public utilities and appurtenances, including power lines; and
WHEREAS, a public hearing was held on October 26, 2021, for the purpose of
discussing the proposed acquisition of a utility easement located through a part of Lot Ten (10),
Platte Valley Industrial Park Third Subdivision, in the City of Grand Island, Hall County, Nebraska,
and more particularly described as follows:
Commencing at the Northwest corner of Lot Ten (10), Platte Valley Industrial Paxk
Third Subdivision, in the City of Grand Island, Hall County, Nebraska; thence running
along the northerly line of said Lot Ten (10), on an assumed bearing of S88°28'39"E, a
distance of two hundred ninety-one and one tenth (291.1) feet; thence S 1°31' 21 "W, a
distance of forty-seven and five tenths (47.5) feet to a point on the southerly line of an
existing twenty (20.0) foot wide utility easement described in Instrument #200309425,
recorded in the Hall County, Nebraska Register of Deeds Office, said point being the
ACTUAL Point of Beginning; thence continuing S 1°31' 21 "W, a distance of ten (10.0)
feet; thence S88°28'39"E a distance of fifty-five (55.0) feet; thence S1°31'21"W, a
distance of one hundred twenty (120.0) feet; thence N1°31'21"E, a distance of one
hundred thirty (130.0) feet to a point on the southerly line of said existing twenty (20.0)
foot wide utility easement; thence N88°28'39"W, along the southerly line of said
existing twenty (20.0) foot wide utility easement, a distance of seventy-five (75.0) feet to
the said Point of Beginning.
The above-described easement and right-of-way containing a total of .072 acres, more or
less as shown on the plat dated 9/15/2021, marked Exhibit "A", attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Mountain Tower & Land, LLC, on the above-
described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska, October 26, 2021.
