06/22/2021 Resolutions 2021-137RESOLUTION 2021-137 WHEREAS, a public utility easement is required by the City of Grand Island from GIG Ventures, LLC, to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including power lines and; WHEREAS, a public hearing was held on June 22, 2021, for the purpose of discussing the proposed acquisition of a twenty (20.0) foot utility easement located through a part of the South Half of the Southwest Quarter (S'/2, SW'/4) of Section Thirty-Two (32), Township Eleven (11) North, Range Nine (9) West of the 6�' P.M., in the City of Grand Island, Hall County, Nebraska, and more particularly described as follows: Commencing at the Southwest corner of Section Thirty-Two (32), Township Eleven (11) North, Range Nine (9) West of the 6�' P.M., in the City of Grand Island, Hall County, Nebraska; thence easterly along the southerly line of said Section Thirty- Two (32), a distance of three hundred thirty-five and one tenth (335.10) feet; thence deflecting left 92°34' S6" and running in a northerly direction, a distance of thirty- three (33.0) feet to a point on the northerly right-of-way line of Schimmer Drive, said point being the ACTUAL Point of Beginning; thence continuing in a northerly direction, a distance of one hundred seventy-three and nine tenths (173.9) feet; thence deflecting left 47°53'S1" and running in a northwesterly direction, a distance of thirty-two (32.0) feet to the point of termination. The side lines of the above described tract shall be prolonged or shortened as required to terminate on the boundary of Grantor's property. The above-described easement and right-of-way containing a total of 0.095 acres, more or less, as shown on the plat dated 5/12/2021, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from GIG Ventures, LLC, on the above-described tract of land.
