07/28/2020 Resolutions 2020-168RESOLUTION 2020-168 WHEREAS, a public utility easement is required by the City af Grand Island from Hooker Bros., Sandy & Gravel, Inc., to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including power lines and; WHEREAS, a public hearing was held on July 28, 2020, for the purpose of discussing the proposed acquisition of a twenty (20.0) foot utility easement located through a part of the North Half (N '/2), of the Southeast Quarter (SE '/4), Section T'hirly-Three (33), Township Eleven (11) North, Range Nine (9) West of the 6�' P.M., Hall County, Nebraska, and more particularly described as follows: Commencing at the Southeast corner of the Southeast Quarter (SE1/4), Section Thirty- Three (33), Township Eleven (11) North, Range Nine (9) West of the 6�' P.M., Hall County, Nebraska; thence on an assumed bearing of N00° 13' 14"E, along the easterly line of said Southeast Quarter (SEl/4), a distance of one thousand five hundred twenty- eight and thirty-seven hundredths (1,528.37) feet; thence N88°04'49"W, a distance of seveniy-five and eighty-one hundredths (75.81) feet to a point on the westerly right-of- way line of Locust Street being the ACTUAL Point of Beginning; thence continuing N88°04'49"W, along a particular East-West line of a tract of land described in Instrument No. 99107665, recorded in tl2e Ha11 County, Nebraska Register of Deeds Office, a distance of one hundred sixty-six and thirty-eight hundredths (16638) feet; thence S56°18'S0"W, a distance of ninety-nine and twenty-three hundredths (99.23) feet; thence N33°41' 10"W, a distance of twenty (20.0) feet; thence N56°18'S0"E, a distance of one hundred five and sixty-five hundredths (105.65) feet; thence S88°04'49"E, a distance of one hundred seventy-two and thirteen hundredths (172.13) feet to a point on the westerly right-of-way line of said Locust Street; thence S00° 13' 14"W along the westerly righ#-of-way of said Locust Street; a distance of twenty (20.0) feet to the said Point of Beginning. T'he above-described easement and right-of-way containing .12 acres more or less, as shown on the plat dated 7/7/2020, marked E�ibit "A", attached hereto and incorpora.ted herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acqtzire a public utility easement from Hooker Bros. Sand & Gravel, lnc., on the above- described tract of land. Adopted by the City Council of the City of Grand Island, Nebraska, July 28, 2020.
