06/09/2020 Resolutions 2020-129RESOLUTION 2020-129 WHEREAS, a public utility easement is required by the City of Grand Island from Old Dominion Freight Line, Inc., to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including power lines and; WHEREAS, a public hearing was held on June 9, 2020, for the purpose of discussing the proposed acquisition of a twenty (20.0) foot utility easement located through a part of Lot Eighteen (18), Platte Valley Industrial Park Third Subdivision, in the City of Grand Island, Hall County, Nebraska, and more particularly described as follows: Commencing at the Northeast corner of Lot Eighteen (18), Platte Valley Industrial Park Third Subdivision, in the City of Grand Island, Hall County, Nebraska; thence southerly along the easterly line of said Lot Eighteen (18), distance of two hundred fourteen and forty-seven hundredths (214.47) feet to the ACTUAL Point of Beginning; thence deflecting right 88°16'S8"and running in a westerly direction, a distance of two hundred eighty-seven and nine hundredths (287.09) feet; thence deflecting left 84°43'S4" and running in a southerly direction, a distance of fifty- seven (57.0) feet to the point of termination. The above-described easement and right-of-way containing a total of .16 acres, more or less as shown on the plat dated 5/14/2020, marked Exhibit "A", attached hereto and incorporated herein by reference. NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Old Dominion Freight Line, Inc., on the above- described tract of land.
