RESOLUTION 2020-110
WHEREAS, a public utility easement is required by the City of Grand Island from
Dana Point Development Corporation, to survey, construct, inspect, maintain, repair, replace,
relocate, extend, remove, and operate thereon, public utilities and appurtenances, including water
mains; and
WHEREAS, a public hearing was held on May 12, 2020, for the purpose of
discussing the proposed acquisition of a fifteen (15.0) foot utility easement located through a part of
Lot Four (4) and Lot Five (5), all in Block Two (2), McCoy Meadows Subdivision, in the City of
Grand Island, Hall County, Nebraska, and more particularly described as follows:
Referring to the Northeast corner of McCoy Meadows Subdivision, in the City of
Grand Island, Hall County, Nebraska; thence southerly along the East line of said
McCoy Meadows Subdivision, a distance of ten (10.0) feet to the ACTUAL Point of
Beginning, said point being on the southerly line of an existing ten (10.0) foot utility
easement in said McCoy Meadows Subdivision; thence continuing southerly along the
East line said McCoy Meadows Subdivision, a distance of sixty-four and twenty-four
hundredths (64.24) feet to a point on the northerly line of the extension of an existing
fifteen (15.0) foot wide utility easement in said McCoy Meadows Subdivision; thence
westerly along the extension of the said northerly line of an existing fifteen (15.0) foot
wide utility easement, a distance of one hundred ten (110.0) feet; thence northerly at a
right angle to the said northerly line of an existing fifteen (15.0) foot wide utility
easement, a distance of fifteen (15.0) feet; thence easterly and parallel with the said
northerly line of an existing fifteen (15.0) foot wide utility easement , a distance of
ninety-five (95.0) feet to a point fifteen (15.0) feet westerly of, as measured at right
angles to, the East line of said McCoy Meadows Subdivision; thence northerly and
fifteen (15.0) feet westerly and parallel to the East line of said McCoy Meadows
Subdivision, a distance of forty-nine and twenty-four hundredths (49.24) feet to a point
on the said southerly line of an existing ten (10.0) foot utility easement; thence easterly
along the said southerly line of an existing ten (10.0) foot utility easement, a distance
of fifteen (15.0) feet to the said Point of Beginning.
The above-described easement and right-of-way containing a total of .055 acres, more
or less as shown on the plat dated 4/2/2020, marked Exhibit "A", attached hereto and
incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Dana Point Development Corporation, on the
above-described tract of land.
