WHEREAS, a public utility easement is required by the City of Grand Island from
Richard Landell and Kim Landell, to survey, construct, inspect, maintain, repair, replace, relocate,
extend, remove, and operate thereon, public utilities and appurtenances, including lines and
transformers; and;
WHEREAS, a public hearing was held on April 24, 2018, for the purpose of
discussing the proposed acquisition of a twenty (20.0) foot utility easement located through a part of
the Southwest Quarter ofthe Southeast Quarter (SW'/4, SE'/4) of Section One (1), Township Eleven
(11) North, Range Nine (9) West of the 6th P.M., in the City of Grand Island, Hall County, Nebraska;
and more particularly described as follows:
Commencing at the Southwest corner of the Southwest Quarter of the Southeast
Quarter (S W 1/4, SE 1/4), Section One (1), Township Eleven (11) North, Range Nine
(9) West of the 6�' PM, in Hall County, Nebraska; thence easterly, along the southerly
line of said Southwest Quarter of the Southeast Quarter (SWl/4,SE1/4), a distance of
one thousand two hundred seventy two and three tenths (1,272.3) feet; thence
northerly and perpendicular to the southerly line of the said Southwest Quarter of the
Southeast Quarter (SW 1/4,SE1/4), a distance of thirty three (33.0) feet to a point on
the northerly right-of-way line of Capital Avenue, being the ACTUAL Point of
Beginning; thence deflecting left 18°06'S1" in anorthwesterly direction, a distance of
one hundred eighty three (183.0) feet to the point of termination. The side lines of the
above described tract shall be prolonged or shortened as required to terminate on the
boundary of Grantor's property.
The above easement and right of way containing 0.08 acres, more or less, as shown
on the plat dated 3/20/2018, marked Exhibit "A" attached hereto and incorporated
herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Richard Landell and Kim Landell, on the above-
described tract of land.
