WHEREAS, a public utility easement is required by the City of Grand Island from
Douglas R. and Tamara K. Petersen, to survey, construct, inspect, maintain, repair, replace, relocate,
extend, remove, and operate thereon, public utilities and appurtenances, including lines and
transformers; and;
WHEREAS, a public hearing was held on November 14, 2017, for the purpose of
discussing the proposed acquisition of a utility easement located through a part of the Northwest
Quarter (NW'/4), Section Twenty (20), Township Twelve (12) North, Range Nine (9) West ofthe 6�'
P.M., Hall County, Nebraska; and more particularly described as follows:
Commencing at the Northeast corner of the Northwest Quarter (NW 1/4) of Section Twenty
(20), Township Twelve (12) North, Range Nine (9) West of the 6�' P.M., Hall County,
Nebraska; thence N89° 15'41 "W, along the northerly line of said Northwest Quarter
(NW1/4), a distance of one thousand one hundred nine and ninety four hundredths
(1,109.94) feet; thence S00°43'S5"W, a distance forty five (45.0) feet to a point on the
southerly right-of-way line of One-R Road, said point being the ACTUAL Point of
Beginning; thence continuing S00°43'S5"W, a distance of five hundred fifty three and
thirty four hundredths (553.34) feet; thence S 18°25' 12"E, a distance of three hundred sixty
five and eighty seven hundredths (365.87) feet; thence S00°14' 11"W, a distance of three
hundred ninety two and fifty eight hundredths (392.58) feet; thence N89°46'45"W, a
distance of two hundred fifty nine and ninety four hundredths (259.94) feet; thence
S00°14'41"W, a distance of three hundred eighty six and eighty one hundredths (386.81)
feet; thence S58°23'44"W, along the easterly line of Prairie Creek Meadows Subdivision, a
distance of six hundred seven and twenty four hundredths (607.24) feet; thence
S44°32'OS"W, along the easterly line of said Prairie Creek Meadows Subdivision, a
distance of four hundred and one hundredth (400.01) feet; thence S 14°59'09"W, along the
easterly line of said Prairie Creek Meadows Subdivision, a distance of two hundred eighty
seven and seventy five hundredths (287.75) feet to a point of termination on the southerly
line of the said Northwest Quarter (NW1/4). The side lines of the above described tract
shall be prolonged or shortened as required to terminate on the boundary of Grantor's
property.
The above-described easement and right-of-way containing a calculated area of 1.49 acres
more or less, as shown on the plat dated 10/5/2017, marked Exhibit "A", attached hereto
and incorporated herein by reference.
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Douglas R. and Tamara K. Petersen, on the
above-described tract of land.
