10/10/2017 Ordinances 9657ORDINANCE NO. 9657 An ordinance directing and authorizing the conveyance of property to Starostka Group Unlimited, Inc.; providing for the giving of notice of such conveyance and the terms thereof; providing for notice of public hearing held on acquisition; providing for the right to file a remonstrance against such conveyance; authorizing the execution and delivery of a deed; providing for publication and the effective date of this ordinance. BE IT ORDAINED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA: SECTION 1. The City will convey to Starostka Group Unlimited, Inc., a Nebras- ka corporation, the City's interests in and to the lands described as follows: The south ten (10) feet of Lot Six (6), Block Two (2), and the south ten (10) feet of Lot Twelve (12), Block One (1), all in Sterling Estates Eighth Subdivision in the City of Grand Island, Hall County, Nebraska; SECTION 2. Conveyance of the real estate above described to Starostka Group Unlimited, Inc. shall be by special warranty deed for and in consideration of the subdivision agreements for Sterling Estates Fourth and Sterling Estates Eighth Subdivision and for and in consideration of conveyance to the City of Grand Island the following described tracts, to wit: A part of Outlot A in Sterling Estates Fourth Subdivision in the City of Grand Island, Hall County, Nebraska, more particularly described as follows: Commencing at the Northeast (NE) corner of Lot Eight (8), Block Two (2) in Sterling Estates Fourth Subdivision; thence north along the east boundary of said Outlot A a distance of 10 feet; thence west on a line parallel with the north boundary of said Lot Eight (8), Block Two (2) a distance of 124.0 feet; thence south to the northwest (NW) corner of said Lot Eight (8), Block Two (2); thence .. Approved as to Form R October 9, 17 � orney �� ORDINANCE NO. 9657 (Cont.) east upon the north boundary of Lot Eight (8), Block Two (2) to the point of be- gmnmg; and The South 10 feet of Outlot B in Sterling Estates Fourth Subdivision in the City of Grand Island, Hall County, Nebraska; SECTION 3. As provided by law, notice of such conveyance and the terms thereof shall be published for three consecutive weeks in the Grand Island Independent, a news- paper published for general circulation in the City of Grand Island. Immediately after the pas- sage and publication of this ordinance, the City Clerk is hereby directed and instructed to prepare and publish said notice. SECTION 4. As required by law, by enactment of this Ordinance, the City Coun- cil of the City of Grand Island does hereby authorize the acquisition of the above-described tracts by action taken in a public meeting after notice and public hearing. SECTION 5. Authority is hereby granted to the electors of the City of Grand Is- land to file a remonstrance against the conveyance of such within described real estate; and if a remonstrance against such conveyance signed by registered voters of the City of Grand Island equal in number to thirty percent of the registered voters of the City of Grand Island voting at the last regular municipal election held in such City be filed with the City Council within thirty days of passage and publication of such ordinance, said property shall not then, nor within one year thereafter, be conveyed. SECTION 6. The conveyance of said real estate is hereby authorized, directed and confirmed; and if no remonstrance be filed against such conveyance, the Mayor shall make, execute and deliver to Starostka Group Unlimited, Inc., a special warranty deed for said real es- -2- I i , � ORDINANCE NO. 9657 (Cont.) tate, and the execution of such deed is hereby authorized without further action on behalf of the City CounciL SECTION 7. This ordinance shall be in force and take effect from and after its passage and publication, within fifteen days in one issue of the Grand Island Independent as pro- vided by law.
