01/10/2017 Resolutions 2017-1RESOLUTION 2017-1 WHEREAS, a public utility easement is required by the City of Grand Island from Hatchery Holdings, LLC, to survey, construct, inspect, maintain, repair, replace, relocate, extend, remove, and operate thereon, public utilities and appurtenances, including lines and transformers; and; WHEREAS, a public hearing was held on January 10, 2017, for the purpose of discussing the proposed acquisition of an easement located through a part of the Northeast Quarter (NE '/a), Section Five (5), Township Ten (10) North, Range Nine (9) West of the 6�' P.M., the centerline of the twenty (20.0) foot wide utility easement and right-of-way, in the City of Grand Island, Hall County, Nebraska; being more particularly described as follows: Commencing at the Northeast corner of the Northeast Quarter (NE 1/4), Section Five (5), Township Ten (10) North, Range Nine (9) West of the 6�' P.M., in the City of Grand Island, Hall County, Nebraska; thence N90°00'00"W, along the northerly line of said Northeast Quarter (NE1/4), a distance of four hundred seventy eight and twenty seven hundredths (478.27) feet; thence S 12°41' 15"E, a distance of thirty three and eighty three hundredths (33.83) feet to a point on the southerly right-of-way line of Schimmer Drive, being the ACTUAL Point of Beginning; thence continuing S12°41'15"E, a distance of one hundred forty two (142.0) feet to the point of termination. The side lines of the above described tract shall be prolonged or shortened as required to terminate on the boundary of Grantor's property. The above-described easement and right-of-way containing 0.065 acres, more or less, as shown on the plat dated 11/10/2016, marked Exhibit "A", attached hereto and incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Hatchery Holdings, LLC, on the above- described tract of land.
