06/24/2014 Resolutions 2014-170 RESOLUTION 2014-170 WHEREAS, a public utility easement is required by the City of Grand Island from Craig A. Dixson and Lesa M. Dixson, to survey, construct, inspect, maintain, repair, replace, relocate,extend,remove,and operate thereon, public utilities and appurtenances,including lines and transfoiulers; and; WHEREAS, a public hearing was held on June 24, 2014, for the purpose of discussing the proposed acquisition of a twenty foot wide easement the center line of which is located in Hall County, Nebraska; and more particularly described as follows: Commencing at the Northeast corner of the Northeast Quarter(NE 1/4), Section Thirty Six (36), Township Eleven (11) North, Range Nine (9) West of the 6th P.M., Hall County, Nebraska; thence along the northerly line of the said Northeast Quarter (NE 1/4), on an assumed bearing of N89°55'53"W, a distance of seven hundred forty nine and fifty two hundredths (749.52) feet; thence S0°04'07"W, a distance of thirty three (33.0) feet to a point on the southerly right-of-way line of Husker Highway,said point being the ACTUAL Point of Beginning;thence 531°17'22"W,a distance of seven hundred forty five and forty five hundredths (745.45) feet to a point on the northerly line of Lot One (1), Dixson Subdivision, Hall County, Nebraska. The side lines of the above described tract shall be prolonged or shortened as required to terminate on the boundary of Grantor's property. The above-described easement and right-of-way containing 0.34 acres, more or less, as shown on the plat dated 6/3/2014, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Craig A. Dixson and Lesa M. Dixson, on the above-described tract of land.
