WHEREAS, a public utility easement is required by the City of Grand Island from
Mid Plains Construction Company,to survey,construct,inspect,maintain,repair,replace,relocate,
extend, remove, and operate thereon, public utilities and appurtenances, including lines and
transformers; and;
WHEREAS, a public hearing was held on June 10, 2014, for the purpose of
discussing the proposed acquisition of a twenty foot wide easement located in the City of Grand
Island,Hall County,Nebraska;and the centerline of which is more particularly described as follows:
Beginning at a point on the easterly line of a tract of land described in Instrument Number
201400101 recorded in the Register of Deeds Office, Hall County, Nebraska said point
being forty four(44.0) feet northerly and thirty seven(37.0) feet westerly of the southeast
corner of the Northeast Quarter of the Southeast Quarter (NE 1/4, SE 1/4) of Section
Thirteen (13), Township Eleven(11)North, Range Ten(10) West of the 6th P.M., Grand
Island, Hall County,Nebraska; thence westerly and forty four(44.0) feet parallel with the
southerly line of the said Northeast Quarter of the Southeast Quarter (NE1/4, SE1/4) of
Section Thirteen (13), Township Eleven (11) North, Range Ten (10) West, a distance of
two hundred fifty three (253.0) feet to a point on the westerly line of a tract of land
described in said Instrument Number 2014400101.
The above-described easement and right-of-way containing a total of 0.12 acres, more or
less, as shown on the plat dated 5/2/2014, marked Exhibit "A" attached hereto and
incorporated herein by reference.
NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Mid Plains Construction Company, on the
above-described tract of land.
Adopted by the City Council of the City of Grand Island, Nebraska June 10, 2014.
