04/22/2014 Resolutions 2014-87 RESOLUTION 2014-87 WHEREAS, a public utility easement is required by the City of Grand Island from Douglas R. and Tamara K.Petersen,to survey,construct,inspect,maintain,repair,replace,relocate, extend,remove,and operate thereon, public utilities and appurtenances,including water lines,and; WHEREAS, a public hearing was held on April 22, 2014, for the purpose of discussing the proposed acquisition of a 27 foot utility easement located in,Hall County,Nebraska; and more particularly described as follows: Commencing at the northeast corner of the East Half of the Northwest Quarter (E1/2, NW1/4) Section Four (4), Township Eleven (11) North, Range Nine (9) West; thence southerly along the easterly line of the East Half of the Northwest Quarter(E1/2,NW1/4) said Section Four(4),a distance of thirty three(33.0)feet to the southerly right-of-way line of Airport Road, being the ACTUAL Point Of Beginning; thence westerly along the southerly right-of-way line of said Airport Road to a point three hundred(300.0)feet east of the westerly line of the East Half of the Northwest Quarter (E1/2, NW1/4) said Section Four (4); thence southerly and parallel with the westerly line of the East Half of the Northwest Quarter (E1/2, NW1/4) said Section Four (4), a distance of fifty (50.0) feet; thence northwesterly to a point on the easterly line of the East Half of the Northwest Quarter (E1/2, NW1/4) said Section Four (4), said point being twenty seven (27.0) feet south of the southerly right-of-way line of said Airport Road; thence easterly and parallel with the southerly right-of-way line of said Airport Road, to the easterly line of the Northwest Quarter of the Northwest Quarter of the Northeast Quarter (NW1/4, NW1/4, NE 1/4) said Section Four (4); thence northerly along the easterly line of the Northwest Quarter of the Northwest Quarter of the Northeast Quarter(NW1/4,NW1/4,NE1/4) said Section Four(4),a distance of twenty seven(27.0)feet to a point on the southerly right-of- way line of said Airport Road; thence westerly along the southerly right-of-way line of said Airport Road, to the said Point Of Beginning. The above-described easement and right-of-way containing a total of 1.31 acres, more or less, as shown on the plat dated 2/13/2013, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Douglas R. and Tamara K. Petersen, on the above-described tract of land.
