- RESOLUTION 2013-391 WHEREAS, a public utility easement is required by the City of Grand Island, from The Guarantee Group,L.L.C.,to survey,construct,inspect,maintain,repair,replace,relocate,extend,remove,and operate thereon, public utilities and appurtenances, including water lines; and WHEREAS, a public hearing was held on December 17, 2013, for the purpose of discussing the proposed acquisition of an easement located in the City of Grand Island,Hall County,Nebraska;and more particularly described as follows: Beginning at a point on the northerly right of way line of Yarrow Drive, said point being Five and Twenty Six Hundredths (5.26) feet west of the southwest corner of Lot Seven (7), Copper Creek Estates Fifth Subdivision; in the City of Grand Island, Hall County, Nebraska; thence running westerly on the northerly right of way line of Yarrow Drive, if extended, and on an Assumed Bearing of N89°42'46"W, a distance of One Hundred Fifty (150.00) feet; thence running S00°37'21"W, a distance of One Hundred Thirty Five (135.00) feet, to a point of the northerly right of way line of Brome Grass Drive; thence running S89°42'46"E, on the northerly right of way line of Brome Grass Drive, a distance of Sixty(60.00) feet, to a point on the easterly right of way of Brome Grass Drive and to the northwest corner of Lot Thirty Seven(37), Copper Creek Estates Third Subdivision; thence running N00°37'21"E, on the easterly right of way line of Brome Grass Drive, if extended, a distance of Seventy Five (75.00) feet; thence running S89°42'46"E, a distance of Ninety (90.00) feet, to a point on the westerly right of way line of Yarrow Drive and the northwest corner of Lot Twenty (20), Copper Creek Estates Fifth Subdivision; thence running N00°37'21"E, on the westerly right of way line of Yarrow Drive, a distance of Sixty (60.00) feet, to the said Point of Beginning. The above-described easement and right-of-way containing 0.310 Acres, more or less, as shown on the plat dated October 7, 2013, marked Exhibit "A" attached hereto and incorporated herein by reference. NOW,THEREFORE,BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND,NEBRASKA,that the City of Grand Island be,and hereby is,authorized to acquire a public utility easement from The Guarantee Group, L.L.C., on the above-described tract of land.
