WHEREAS, a public utility easement is required by the City of Grand Island, from
Midland Ag Service, Inc., to survey, construct, inspect, maintain, repair, replace, relocate, extend,
remove, and operate thereon, public utilities and appurtenances, including lines and transformers;
and;
WHEREAS, a public hearing was held on June 12, 2012, for the purpose of
discussing the proposed acquisition of an easement twenty feet in width, the centerline of which is
located in the City of Grand Island, Hall County, Nebraska; and more particularly described as
follows:
Commencing at the southwest corner of the Southwest Quarter of the Northwest
Quarter (SW 1/4, NW 1/4), Section Twenty Four (24), Township Eleven (11) North,
Range Nine (9) West; thence on an assumed bearing of N00 °00'00 "E along the
westerly line of said Southwest Quarter of the Northwest Quarter (SW 1/4, NW 1/4),
a distance of two hundred sixty (260.0) feet; thence S89 °56'58 "E along the southerly
line of a tract of land described in Document 200706312 record in the Register of
Deeds Office, Hall County, Nebraska, a distance five hundred twenty eight (528.0)
feet to the ACTUAL Point of Beginning; thence continuing S89 °56'58 "E ", a distance
of thirty five (35.0); thence N00 °00'00 "E, a distance of one hundred seventy five
(175.0) feet; thence N89 °56'58 "W, a distance of thirty five (35) feet to the point on
the easterly line of Lot One (1) Schuchman Subdivision; thence S00 °00'00'W along
the easterly line of said Lot One (1) Schuchman Subdivision and the easterly line of
said tract of land described in Document 200706312, a distance of twenty (20.0) feet;
thence S89 °56'58 "E, a distance of fifteen (15.0) feet; thence S00 °00'00 "W, a
distance of one hundred thirty five (135.0) feet; thence, N89 °56'58 "W, a distance of
fifteen (15.0) feet to a point of the easterly line of said tract of land described in
Document 200706312; thence S00 °00'00 "W along the easterly line of said tract of
land, a distance of twenty (20.0) feet to the said Point of Beginning.
The above - described easement and right -of -way containing 0.094 acres, more or less,
as shown on the plat dated 5/16/2012, marked Exhibit "A" attached hereto and
incorporated herein by reference,
NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF
THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is,
authorized to acquire a public utility easement from Midland Ag Service, Inc., on the above -
described tract of land.
