09/09/2008 Resolutions 2008-237RESOLUTION 2008-237 WHEREAS, a public utility easement is required by the City of Grand Island, from Scannell Properties #106, LLC, to install, upgrade, maintain and repair public utilities and appurtenances, including lines and transformers; and; WHEREAS, a public hearing was held on September 9, 2008, for the purpose of discussing the proposed acquisition of an easement located in the City of Grand Island, Hall County, Nebraska; and more particularly described as follows: Commencing at the northwest corner of Lot Two (2) Platte Valley Industrial Park Third Subdivision; thence southerly along the westerly line of said Lot Two (2), a distance of one hundred ninety six (196.0) feet to the ACTUAL Point of Beginning; thence easterly and perpendicular to the westerly line of said Lot Two (2), a distance of two hundred forty four (244.0) feet; thence southerly and parallel with the westerly line of said Lot Two (2), a distance of twenty (20.0) feet; thence westerly and perpendicular to the westerly line of said Lot Two (2), a distance of two hundred forty four (244.0) feet to a point on the westerly line of said Lot Two (2); thence northerly along the westerly line of said Lot Two (2), a distance of twenty (20.0) feet to the said Point of Beginning. The above-described easement and right-of-way containing a total of 0.11 acres, more or less, as shown on the plat dated 8/20/2008, marked Exhibit "A", attached hereto and incorporated herein by reference, NOW, THEREFORE, BE IT RESOLVED BY THE MAYOR AND COUNCIL OF THE CITY OF GRAND ISLAND, NEBRASKA, that the City of Grand Island be, and hereby is, authorized to acquire a public utility easement from Scannell Properties #106, LLC, on the above-described tract of land. Adopted by the City Council of the City of Grand Island, Nebraska, September 9, 2008.
